So doesn't look like that zdnet article is correct?. I guess being overseas owned they would have also needed that OIA approval as well. So in a way it looks to be a bit meaningless.

Does that mean they can bypass the CC? Or did they need consent from both?
My question too. I'd be surprised if a national business law can be bypassed so easily.
Judging by it saying "instead of" in Mauricio's post I would assume they were able to go around the CC as opposed to through them.
If so, I wonder if it is a loophole? If so I wonder if this means that others could also use it, where they have been previously denied by the CC. IMO the commerce commission is there for a reason. It is also election year so I wonder if that will come into play on this.
no loophole you actually don't need the commerce commissions approval to merge, and they can make a decision as they have with vodafone and sky but it hold no legal standing to stop them merging, so even with that ruling both companies can still merge. The only thing the commerce commission ruling is any good for is if they give the ok to merge that then gives the companies an assurance that they can't be prosecuted for being anti competitive. I expect voda and sky to merge and force the commerce commission to prove in court that it is anti competitive. also expect the other telcos to go to court as well.
DjShadow:Stuff is now reporting the Merger is going to happen

Does the taxpayer have to pay for defending it?

If the Commission decides to defend it then yes.
Here is a crazy notion, lets give peace a chance.
.... and the merger is now off
I think we will see a merger by stealth with very close cooperation.

A LOT of product development and maintenance work in both org's was deferred in favour of being ready for this merger.
In the meantime others have steamrollered on. Expect a hiring surge from both I reckon as they try to catchup.

Seems to be bordering on preferential treatment for being on Voda? I assume they looked into that, and Sky isn't locked into Voda, but the price is. Although its probably a Voda price.
