Its a pity that he was detained due to Covid requirements, non vaxxed, now he's out, there is no safety requirement. So, non vaxxed, you get unfairly treated at the border, that means you can now bypass Covid safety rules, crazy

The border force and the Australian government cocked this up. The lawyers just have to deal with the mess.

No, it’s not crazy. He has to comply with existing Covid rules, as do the Australian authorities.

This has no material effect on Australia other than making them look bad.

The case was about his cancelled Visa. As expected that was reversed. But it still leaves the issue is he eligible quarantine free or not? I get that that the case was not about that. So  his Visa was reinstated, but what next? Is he there legally but has to MIQ or not? Clearly not. So the Covid issue that an asymptomatic previous infection does not mean non MIQ is also reversed. But that wasn't the case but thats how it worked out. It should have been sorry you were not treated fairly at the border. here is your Visa and there is MIQ for the rest of the duration. 

 

But as you mentioned earlier its political, it has nothing to do with Covid at all

AFAIK the rules were if you were symptomatic and sick, thats ok, if you were asymptomatic and feel great, that's not ok, you are not eligible for quarantine free. But his Mom said she he was in Spain that he had no symptoms. Case in point.

 

I feel the case got the correct decision. But the Covid safety measures did not.

OK, thanks, I accept that. makes a mockery of the word Government though. Its like a Canterbury, NZ, government having laws that are a world apart from Wellington. The US/AUS model. There is no "real" Government for the country

The same thing happens in New Zealand. The NZ government doesn't set your rates or establish planning zones. Devolution of powers to different levels of government is entirely normal. In larger countries more powers get devolved, especially if they have federal systems of government. It's just a different system.
