The company could write off a large portion of its $787.5 million settlement it owes Dominion as an income tax deduction.

According to a report from Lever News, Fox News could potentially write off a massive portion of the $787.5 million settlement it has agreed to pay Dominion Voting Systems as a tax deduction. ...

... the company could deduct up to $213 million from their income taxes under provisions in the American tax code that allow companies to write off legal bills as “ordinary and necessary” business expenses.

Since the dispute was settled between two companies, and not with the government, Fox can claim tax benefits on the payment. ...

“If your business model is to tell lies so that you’ll get viewers and have lots of advertising revenues, then, odious though this business model may be, the tax system’s job is to tax you on the profits that you actually make from it,” Daniel Shaviro, a professor of tax law at NYU, told The Lever. “And those profits are indeed reduced when you are successfully sued by the victims of your malicious falsehoods.”

That's the thing, I don't know - but I do live in hope. Remember, Fox is not in the winning corner in this scenario; if Smartmatic really want to push the envelope and see all of Fox's dirty laundry aired (which I can 100% guarantee Fox won't want), Smartmatic will hold out and force a trial. I guess what I'm trying to say is Fox - for once - does not have the advantage here.

The case Dominion has just won will make no difference to Joe Average's view of the political landscape or the media. Even if Murdoch and co had been forced to testify half the US media, the right, would not have even reported it.

Yeah, that's the depressing thing. The Guardian had a political analysis on why it made sense for Dominion to settle, and overall Fox viewers will just keep believing whatever Fox tells them and non-Fox viewers already know what a cesspit it is, so going to trial probably wouldn't have achieved much apart from posturing - most of the dirty laundry was already aired in pre-trial discovery so all you'd get is to see Fox execs squirming under cross-examination.

Even though experts said Dominion had strong evidence to clear the high “actual malice” standard required to prove defamation in the US, a jury could have balked at awarding the relatively obscure company $1.6bn. As enticing as days of testimony from Murdoch and other Fox stars would have been, Dominion had already published the most damaging information ahead of trial. And even if Dominion had won the case at trial, it would not have received an apology from Fox.
