Here’s something to consider: if everything happening with Trump actually was a witch hunt or the result of a weaponized Department of Justice, where are all the lawyers who would surely jump to represent him if these things were actually true? His two lawyers quit when the indictment was unsealed. I just heard on NPR that a local lawyer in Miami was appointed to represent him. Let that sink in—he needed to have a lawyer appointed to represent him. Any lawyer wanting to make a name for him or herself would certainly want to take this case if there was even the slightest hint of impropriety. His lawyer had to be appointed.

Washington Post: Judge Aileen Cannon’s pivotal role in Donald Trump’s criminal trial

Aileen M. Cannon, the federal judge assigned to the Justice Department’s criminal case against former president Donald Trump, will set the pace and rules for how the unprecedented proceedings unfold.

She will be under intense scrutiny, not least because of her past rulings in Trump’s favor in a case related to the classified documents indictment.

When charges of obstruction of justice and willful mishandling against Trump were unsealed last week, special counsel Jack Smith said he would seek a “speedy trial.” And the Southern District of Florida is known for its “rocket docket,” quickly moving cases to trial.

But Trump, now seeking reelection in 2024, has a track record of dragging out court proceedings, often to his advantage, making Cannon’s role in controlling the timeline even more pivotal.

The U.S. Constitution does not list the absence of a criminal record as a qualification for the presidency. It says only that natural born citizens who are at least 35 years old and have been a resident of the U.S. for 14 years can run for president.

Constitutional experts also told ABC News that previous Supreme Court rulings hold that Congress cannot add qualifications to the office of the president. In addition, a state cannot prohibit indicted or convicted felons from running for federal office.

"Some people are surprised to learn that there's no constitutional bar on a felon running for president, but there's no such bar," said Kate Shaw, ABC News legal analyst and professor at Cardozo School of Law.

Judge in Trump Documents Case Has Scant Criminal Trial Experience

Judge Aileen M. Cannon, under scrutiny for past rulings favoring the former president, has presided over only a few criminal cases that went to trial.

Aileen M. Cannon, the Federal District Court judge assigned to preside over former President Donald J. Trump’s classified documents case, has scant experience running criminal trials, calling into question her readiness to handle what is likely to be an extraordinarily complex and high-profile courtroom clash.

Judge Cannon, 42, has been on the bench since November 2020, when Mr. Trump gave her a lifetime appointment shortly after he lost re-election. She had not previously served as any kind of judge, and because about 98 percent of federal criminal cases are resolved with plea deals, she has had only a limited opportunity to learn how to preside over a trial.

A Bloomberg Law database lists 224 criminal cases that have been assigned to her, and a New York Times review of those cases identified four that went to trial. Each was a relatively routine matter, like a felon who was charged with illegally possessing a gun. In all, the four cases added up to 14 trial days.

Judge Cannon’s suitability to handle such a high-stakes and high-profile case has already attracted scrutiny amid widespread perceptions that she demonstrated bias in the former president’s favor last year, when she oversaw a long-shot lawsuit filed by Mr. Trump challenging the F.B.I.’s court-approved search of his Florida home and club, Mar-a-Lago.

In that case, she shocked legal experts across the ideological divide by disrupting the investigation — including suggesting that Mr. Trump gets special protections as a former president that any other target of a search warrant would not receive — before a conservative appeals court shut her down, ruling that she never had legitimate legal authority to intervene.

“She’s both an inexperienced judge and a judge who has previously indicated that she thinks the former president is subject to special rules so who knows what she will do with those issues?” said Julie O’Sullivan, a Georgetown University criminal law professor and former federal prosecutor.

In theory, Judge Cannon could step aside on her own for any reason, or the special counsel, Jack Smith, could ask her to do so under a federal law that says judges are supposed to recuse themselves if their “impartiality might reasonably be questioned” — and, if she declines, ask an appeals court to order her to recuse.

There is no sign that either of them is considering taking that step, however — or what its legal basis would be.

The appeals court last year found that she was wrong about jurisdiction law, not that she was biased. And judges have previously heard litigation involving presidents who appointed them — including the Trump search warrant lawsuit, in which, notably, two of the three appeals court judges who reversed her intervention were also Trump appointees.

By bringing the charges in Florida, where most of the alleged crimes took place, instead of Washington, where the grand jury that primarily investigated the matter sat, the special counsel, Mr. Smith, avoided a potential fight over whether the case was in the right venue but ran the risk that Judge Cannon could be assigned the case.

But the chances appeared low. Under the Southern District of Florida’s practices, a computer in the clerk’s office assigns new cases randomly among judges who sit in the division where the matter arose or a neighboring one — even if the matter relates to a previous case. Nevertheless, Judge Cannon got it.

The chief clerk of the court has said that five active judges were eligible to draw Mr. Trump’s case, and that Judge Cannon’s odds of receiving it were slightly higher than others because half of her cases come from the West Palm Beach division, where Mar-a-Lago is. The clerk has also said normal procedures were followed in making the assignment.

Several lawyers who have appeared before Judge Cannon in run-of-the-mill criminal cases described her in interviews as generally competent and straightforward — and also, in notable contrast to her rulings hobbling the Justice Department after the search, someone who does not otherwise have a reputation of being unusually sympathetic to defendants.

At the same time, they said, she is demonstrably inexperienced and can bristle when her actions are questioned or unexpected issues arise. The lawyers declined to speak publicly because they did not want to be identified criticizing a judge who has a lifetime appointment and before whom they will likely appear again.

Judge Cannon’s four criminal trials identified in the review involved basic charges, including accusations of possession of a gun by a felon, assaulting a prosecutor, smuggling undocumented migrants from the Bahamas, and tax fraud. The four matters generated between two and five days of trial each.

The Trump case is likely to raise myriad complexities that would be challenging for any judge — let alone one who will be essentially learning on the job.

The jury has to deliberate on 37 allegations, each carrying penalties of prison time.

Two stories I saw on what's happening:

This part stuck out to me: Apart from the logistical complications, Trump’s strategy – and his rhetoric on Tuesday evening – also begs another question. Do Republican voters want to fully commit to a campaign almost exclusively focusing on his personal grievances and legal fate? Other than warning that he is taking heat from the Justice Department to shield his supporters, Trump hasn’t offered much of a campaign message to GOP voters on the economy, health care, national security, education and other key issues.

This is quite true. Eventually this court case will finish - but what then? Assuming he wins, what is Trump going to do next? What about the issues raised? Yes he has grievances with the DoJ for being held accountable for his conduct, but what about things like healthcare? Taxes? Education? etc etc etc. So far, he hasn't said anything aside from "my court case is a witch hunt". Outside of his base, for how many Americans is this their #1, top-shelf priority in life?

I don't believe Trump can win, unless something extraordinary happens, like Biden dying of a stroke or heart attack. Unfortunately, the extraordinary seems to have a way of happening in the USA, but if things progress 'normally', Trump will lose big in a general election. His base can carry him through the primaries but there are not enough crazies to overwhelm the national electorate. If the Republicans manage to nominate someone else, anything is possible.

Yes, even if he wins the primaries, as that CNN article points out he struggled to win urban voters in 2020 and that will hurt him in a general election. I agree his base will carry him a good portion of the way, but they won't carry him all the way.

Biden has issues as well, for sure - but nothing like this.

I agree with what has been said above Rikkitic & quickymart but remember there are two elections before inauguration day 20th January 2025.

All the 50 States College Vote elections requiring 170 out of 538 for party candidate and then the national general election on the 5th November 2024 (I'm simplifying this here).

I do not think that even if the State Electors vote along Trump Party lines for Trump to be their representative, that Trump will win the November election, for all the above reasons.

I think we are short changing the general American voting public. They have had a 4 year taste of Trump and the only spectacular thing he did was totally bungle the COVID crisis. Anything else for the people went to all his wealthy friends and corporations, (including the 'small wall'). Oh! he shook hands with an evil dictator. Middle and lower America was poorly done by Trumps administration. The only person to really get anything from his 4 year term was himself.

I could be wrong but a lot of people are going to be well out of pocket for a psychopathic, narcissistic orange buffoon, even well past 20th January 2025. Of course the truly faithful will just stay the truly faithful, "You can educate a fool, but you cannot make him think."

Whilst the difficult we can do immediately, the impossible takes a bit longer. However, miracles you will have to wait for.
