The Atlantic: What Sidney Powell’s deal could mean for the Fulton County case against Trump

Though today’s Sidney Powell’s plea doesn’t offer the public any new information about the prosecutors’ case or the evidence they have, it seems to have a potential to affect the overall Fulton County case in three ways. In short, Kreis told me, “I think there are a lot of people who are in more trouble than they were before.”

First, the plea simplifies the Chesebro trial. Powell and Chesebro had asked for speedy trials, rather than waiting a few months for a more standard trial. Though both are attorneys, their roles were very different. Powell became a household name in the weeks after the election because she often spoke to the press about the election scheme, though her role seems to have been mostly lower-level and operational. Chesebro, by contrast, was little known and had no public profile but worked closely with John Eastman and other lawyers on the broad contours of the paperwork coup.

Removing Powell will narrow the Chesebro trial, which could help prosecutors, but it may also satisfy Chesebro, whose attorneys wanted the cases separated. (Chesebro rejected a deal that would have spared him prison time but required him to plead guilty to a felony and testify, ABC News reports.)

Second, Powell’s plea moves forward the Coffee County portion of the racketeering case. According to prosecutors, the conspirators arranged to unlawfully access and copy data from voting machines in the Southeastern Georgia location. Powell is the second person to plead guilty to involvement there, following Scott Hall, an Atlanta bail bondsman who copped a plea in September. Their testimony may help prosecutors target Jeff Clark, a little-known Justice Department official who attempted to lead a coup inside the department, getting Trump to appoint him acting attorney general, and to convince state legislatures to overturn election results. (He has pleaded not guilty.)

“The person in the gravest of danger [now] is Jeff Clark,” Kreis said. “Now we have a direct chain of individuals who can link Sidney Powell to Scott Hall and Scott Hall to Jeff Clark. Now there’s two witnesses who can presumably talk about the way in which Jeff Clark was not just concocting letters in his office to encourage the general assembly to overturn the election but was involved in and linked to unlawful actions in Georgia.”

Third is the question of how other people accused in the case might react to Powell’s plea. Prosecutors likely hope that it might convince some of the lower-level defendants to conclude that their chances of beating the rap are low but also that cooperating now might produce favorable terms. Agreements to testify would, in turn, presumably make it easier to mount a successful case against the biggest names in the case—Trump, of course, as well as the attorneys Eastman and Rudy Giuliani, and former White House Chief of Staff Mark Meadows. A trial for these defendants likely won’t occur until next year.

“It’s a real prisoner’s dilemma,” Kreis said. “Who’s talking; who’s doing what; what’s the deal I’m going to get? It’s a complicated set of game theory.”

How all of the remaining defendants, with all of their different interests, choose to play will help determine what sort of game is being played: Powell’s conviction could be the first domino in a dramatic cascade, or simply an early piece taken off the board in a long, grueling chess match.

“Why is Judge Engoron’s Principal Law Clerk, Allison R Greenfield, palling around with Chuck Schumer?” Trump posted on social media, along with a picture of her with Schumer and linking to her personal Instagram page.

Engoron had ordered Trump to remove the post and to cease posting about court staff, though the post remained on his campaign website weeks later.

Trump’s lawyer Christopher Kise apologized to the judge for the violation saying that Trump’s “campaign machinery” forgot to take down the post.

BBC: Kenneth Chesebro: Second Trump lawyer pleads guilty to conspiracy

A former lawyer to Donald Trump has pleaded guilty in an election subversion case in the US state of Georgia.

Kenneth Chesebro is the third of 19 co-defendants to plead guilty in a deal with Fulton County prosecutors.

He is accused of putting forward a slate of fake pro-Trump electors in Georgia and other states to overturn the outcome of the 2020 election.

Mr Trump is among those charged in the case. He has pleaded not guilty.

Chesebro's plea deal comes a day after another ex-Trump lawyer, Sidney Powell, admitted guilt in the case.

A third co-defendant, bail bondsman Scott Hall, struck a plea deal with prosecutors in late September.

When law enforcement tries to take down a head of the crime family, like Trump, they have to get cooperation from the lieutenants and soldiers.

The underlings may be more unsavory than boss, but the goal to disassemble the organization.

CBNC: Judge fines Trump $5,000 for gag order violation after threatening him with jail time

A judge fined Donald Trump $5,000 after threatening the former president with jail time over a “blatant violation” of a partial gag order in his $250 million New York fraud trial.

But Manhattan Supreme Court Judge Arthur Engoron warned that future violations will subject Trump to “far more severe sanctions” — including imprisonment.

The judge’s punishment, while a small financial burden, is the first time Trump has faced tangible consequences for violating court-ordered restrictions on his speech.

“This is a blatant violation of the gag order. I made it clear failure to comply will result in serious sanctions,” the judge said. “It remained on the Donald J. Trump campaign site and in fact it has been on there for the past 17 days, [and] it was removed late last night after an email from this court.”

Defense attorney Christopher Kise apologized on Trump’s behalf, saying the violation was unintentional.

Engoron said he would take Kise’s remarks “under advisement,” but added that Trump “is still responsible for what appears on the site.”

“I want to make clear that Mr. Trump is responsible for the large machine, even if it is a large machine,” the judge said, according to NBC.

In his written order Friday afternoon, Engoron said that the effect of the post on the clerk remains, regardless of whether or not it was left up intentionally.

“Moreover, a defendant may not evade liability for violating a court order by assertion that the violation was a result of the actions of one or more of the defendant’s employees or agents,” Engoron wrote.

“In the current overheated climate, incendiary untruths can, and in some cases already have, led to serious physical harm, and worse,” he wrote.

Trump has “received ample warning” about the consequences of violating his gag order, and he has vowed to abide by it, wrote the judge. “Accordingly, issuing yet another warning is no longer appropriate; this Court is way beyond the ‘warning’ stage.”

Still, Engoron decided to impose the $5,000 fine because it was a first-time violation, and because the Trump’s attorneys insisted it was not intentional.

“Make no mistake,” Engoron added. “Future violations, whether intentional or unintentional will subject the violator to far more severe sanctions, which may include, but are not limited to, steeper financial penalties, holding Donald Trump in contempt of court, and possibly imprisoning him” in accordance with state law.

Hopefully! People who take the „liberty“ of parking in the middle of the street and pay fines as parking fees out of their petty cash should have their cars chained until they understand. Well, he (still) has a few cars to change.

Short version: he picked the wrong country for trying this shit.

I'm not defending the weak punishments dished out to Trump and allies so far. However it is following an accelerated pattern: missing diplomatic verbal warnings, missing diplomatic written warning, straight into strong written and verbal warnings, then a "we're serious" weak financial warning.

I expect the next strike will be a "please explain now" meeting, a substantial fine plus a written apology from Trump (which will humiliate him).

And that will trigger him into a tantrum, and something serious, possibly some days in jail.

The entire point of these motions by Trump & his incompetent law teams is:

 

(1) Delay, stall and hope to extend the trial judgments and sentencing beyond November 5, 2024, then have Trump claim he won the Presidency in 2024 so he can claim he can no longer be prosecuted, cases all closed; and

 

(2) Meanwhile, air every step of every trial in the court of MAGA public opinion. This is to escalate the generation of hate propaganda directed toward his long list of enemies ... while also fund-raising from the gullible MAGAs.
