New York Times: A Troubling Trump Pardon and a Link to the Kushners

Even amid the uproar over President Donald J. Trump’s freewheeling use of his pardon powers at the end of his term, one commutation stood out.

Jonathan Braun of New York had served just two and a half years of a decade-long sentence for running a massive marijuana ring, when Mr. Trump, at 12:51 a.m. on his last day in office, announced he would be freed.

Mr. Braun was, to say the least, an unusual candidate for clemency.

A Staten Islander with a history of violent threats, Mr. Braun had told a rabbi who owed him money: “I am going to make you bleed.” Mr. Braun’s family had told confidants they were willing to spend millions of dollars to get him out of prison.

The pardon dealt a substantial blow to an ambitious criminal investigation being led by the Justice Department’s U.S. attorney’s office in Manhattan aimed at punishing members of the predatory lending industry who hurt small businesses. Mr. Braun and prosecutors were in negotiations over a cooperation deal in which he would be let out of prison in exchange for flipping on industry insiders and potentially even wearing a wire. But the commutation instantly destroyed the government’s leverage on Mr. Braun.

The investigation into the industry, and Mr. Braun’s conduct, remains open but hampered by the lack of an insider.

At multiple levels, up to the president, the justice system appeared to fail more than once to take full account of Mr. Braun’s activities. After pleading guilty to drug charges in 2011, Mr. Braun agreed to cooperate in a continuing investigation, allowing him to stay out of prison but under supervision for nine years — a period he used to establish himself as a predatory lender, making violent threats to those who owed him money, court filings show.

Since returning to predatory lending after being freed, Mr. Braun is still engaging in deceptive business tactics, regulators and customers say.

In working to secure his release, Mr. Braun’s family used a connection to Charles Kushner, the father of Jared Kushner, Mr. Trump’s son-in-law and senior White House adviser, to try to get the matter before Mr. Trump. Jared Kushner’s White House office drafted the language used in the news release to announce commutations for Mr. Braun and others.

Pence was under enormous pressure and nearly gave Trump the Republic on Jan 6th. It was a very close thing at times as his journals reveal:

HuffPo: “Not feeling like I should attend electoral count,” he wrote, according to a report Tuesday by ABC News. “Too many questions, too many doubts, too hurtful to my friend. Therefore I’m not going to participate in certification of election.”

But Pence soon abandoned that notion and returned to his previous plan to preside over the Jan. 6, 2021, ceremony, citing a conversation with his son, an active-duty Marine, who reminded him that both had taken an oath to protect and uphold the U.S. Constitution.

It does not get closer than that.

The man who essentially ended the federal right to abortion thinks that he can now run for president in 2024 as a “moderate” on the issue.

In recent weeks, according to two people familiar with the matter, Donald Trump has privately remarked that several anti-abortion leaders — people who spent the past year pushing him to commit to enacting a draconian national ban — now have no “leverage” to force him to do anything.

Despite their very public pressure campaign for that abortion ban, the former president insists that they will all fall in line and back him soon enough — with or without specific policy promises — in large part because they have nowhere else to turn. Trump has also mocked certain “disloyal” and “out of touch” leaders in the movement for tacitly supporting Florida governor and GOP presidential candidate Ron DeSantis, who has failed to loosen Trump’s grip on the party, one of the sources adds.

According to the two sources and other Trump allies and aides familiar with the situation, Trump and his team are looking past the primary towards a general-election fight against President Joe Biden — and they think they can somehow run the former president as a supposed “moderate” (as three sources put it) on abortion, at least compared to the majority of the 2024 Republican field. For months, the sources tell Rolling Stone, Trump and some of his closest aides — such as top campaign adviser Susie Wiles — have planned for the ex-president to position himself in a way that “makes both Republicans and Democrats very happy,” as Trump is fond of saying.

Trump was privately pressing Pence to reject certain votes at the Jan. 6 proceedings and block certification of the election -- and Trump even suggested to Pence that perhaps he should skip the session altogether, Pence allegedly told Smith's team. But, according to sources, Pence told investigators that he "clearly and repeatedly" emphasized to Trump that rejecting certain votes would violate the Constitution.

"I told him I thought there was no idea more un-American than the idea that any one person could decide what electoral votes to count," Pence allegedly told Smith's team, echoing what he has said before in his book and other public forums. "I made it very plain to him that it was inconsistent with our history and tradition."

Pence insisted that in America, under the Constitution establishing three co-equal branches of government, election disputes are resolved by courts and elected lawmakers, sources said.

But, the sources said, with the pressure on Pence mounting, he concluded on Christmas Eve -- just for a moment -- that he would follow Trump's suggestion and let someone else preside over the proceedings on Jan. 6, writing in his notes that doing otherwise would be "too hurtful to my friend."

"Not feeling like I should attend electoral count," Pence wrote in his notes in late December. "Too many questions, too many doubts, too hurtful to my friend. Therefore I'm not going to participate in certification of election."

Then, sitting across the table from his son, a Marine, while on vacation in Colorado, his son said to him, "Dad, you took the same oath I took" -- it was "an oath to support and defend the Constitution," Pence recalled to Smith's investigators, sources said.

That's when Pence decided he would be at the Capitol on Jan. 6 after all, according to the sources.

The Guardian - Trump attacks wife of New York judge after gag order reinstated by court

Trump on Wednesday attacked Dawn Engoron, the wife of the judge, Arthur Engoron, and the judge’s clerk, on his social media platform Truth Social.

 

He called Dawn Engoron a “Trump hating wife” and said that she and Arthur Engoron’s law clerk had “taken over control of the New York State Witch Hunt Trial aimed at me, my family, and the Republican Party”.

 

On Thursday, the gag order against him, which had been paused two weeks ago, was reinstated, but it did not stop Trump lashing out further.

 

The order only specifies comments about members of Judge Engoron’s staff, not his family.

Let’s stop the wishful thinking and face the stark reality: There is a clear path to dictatorship in the United States, and it is getting shorter every day. 

 

In 13 weeks, Donald Trump will have locked up the Republican nomination. 

 

In the RealClearPolitics poll average (for the period from Nov. 9 to 20), Trump leads his nearest competitor by 47 points and leads the rest of the field combined by 27 points. 

 

The idea that he is unelectable in the general election is nonsense - he is tied or ahead of President Biden in all the latest polls - stripping other Republican challengers of their own stated reasons for existence. 

 

The fact that many Americans might prefer other candidates will soon become irrelevant when millions of Republican voters turn out to choose the person whom no one allegedly wants. ...

 

Barring some miracle, Trump will soon be the presumptive Republican nominee for president. ...

 

But Trump will not only dominate his party. He will again become the central focus of everyone’s attention. 

 

Even today, the news media can scarcely resist following Trump’s every word and action. 

 

Once he secures the nomination, he will loom over the country like a colossus, his every word and gesture chronicled endlessly. ...
