I can imagine Trump's lawyer using this defense in a bank robbery: "What is a demand note and money? There are just paper, just a few sheets of used paper. Most of it was printed before the COVID outbreak. How is using filthy old paper a crime?"

What was that case Blanche will be making on his client’s behalf? Blanche repeatedly reminded the jury that Trump is a former president and that he will refer to him as “President Trump” (and perhaps not the more customary “my client”) “out of respect for the office.”

Trump, though, isn’t just a former president. “He’s also a man; he’s a husband, he’s a father, he’s a person just like you and just like me,” Blanche added. The stuff of Clarence Darrow, this was not. Blanche continued with what would amount to the defense’s case: The prosecution’s documents charges are convoluted and not even truly criminal; the primary witnesses, Michael Cohen and Stormy Daniels, can’t be trusted; and this prosecution is for alleged crimes that are really old (most of the evidence, he informed jurors, was “from years and years ago, pre-COVID,” as if the pandemic offered a clean sheet, wiping out everyone’s crimes).

Blanche laid out exactly how Trump paid Cohen (for what the defense claims were legal services and prosecutors claim was a hush money reimbursement to Daniels), before indignantly declaring: “None of this was a crime.”

“What on earth is a crime? What is a crime about what I just described?” Blanche asked the jury, in reference to the various accounting procedures of the Trump Organization. “The 34 counts, ladies and gentleman, are literally just 34 pieces of paper.”

Newsmax host Eric Bolling asked South Dakota Gov. Kristi Noem whether her book editor could have been “a liberal plant” intent on making her look bad after Noem received backlash over several passages from her new memoir.

Reacting to the controversies surrounding Noem’s book – including an extract which detailed the governor’s decision to kill her 14-month-old dog Cricket after it proved “less than worthless” as a hunting animal – Bolling said:

"I’ve also written a couple of books and I know how the process works. You write some chapters, you don’t write the whole book at once. You write a chapter or two, you send it to the editors, and they edit, they read it, they add, they subtract, and here’s my question. The editor, the editor, was she possibly a plant? A liberal plant? Because I’m not sure either one of these stories – the dog story, the North Korea story – seems like the Kristi Noem I know."

Noem’s book generated even more controversy this week after she was accused of lying about a supposed meeting with North Korean leader Kim Jong-un in another section of the memoir, which has since been removed.

During an interview with Fox News host Jesse Watters on Monday, Noem refused to say whether she had ever met with the North Korean leader.

[Tim] Scott, who is on the shortlist of Donald Trump’s potential vice presidential picks, didn’t just deny the 2020 results. As Klepper pointed out, he pre-denied the 2024 vote count during a wild interview in which he repeatedly refused to accept the results, saying only that Trump will be the next president.

 

“This is how humiliating it is to be on Trump’s team: Normal questions become trick questions,” said Klepper, who is hosting “The Daily Show” this week. “This is not a hard question. It’s like when the band comes out and says, ‘Are you ready to party?’ Just say yes and enjoy Imagine Dragons like a responsible adult.”

 

However after January 6, fortunately the Electoral Count Act was changed/clarified so that the Vice President couldn't just decide whether they wanted to certify the election or not; all they can do now is count the votes for each state, nothing more (which is exactly what Pence did).

On December 22, 2022, the United States Senate passed the Electoral Count Reform and Presidential Transition Improvement Act of 2022, sponsored by Senator Susan Collins of Maine and Senator Joe Manchin of West Virginia. After about a year of negotiations, it became as Division P of the Consolidated Appropriations Act, 2023, which passed 68–29 in the Senate and 225–201 in the House the following day. It was signed into law by President Joe Biden on December 29.

 

Some of the highlights of the bill:

 

  •     Identifies each state's governor as responsible for submitting certificates of ascertainment, unless otherwise specified by state laws or constitutions.
  •     Provides for expedited review, including a three-judge panel with a direct appeal to the Supreme Court, of certain claims related to a state's certificate identifying its electors.
  •     Requires Congress to defer to slates of electors submitted by a state's executive pursuant to the judgments of state or federal courts.
  •     Clarifies that the vice president cannot solely determine, accept, reject, or otherwise adjudicate disputes over electors.
  •     Raises objection threshold from one member of each chamber to 20% of each chamber.
  •     Prohibits state legislatures from declaring a "failed election." They can now move their election only under "extraordinary and catastrophic" circumstances.

Granted, this stuff shouldn't really need to be there at all as it's nothing more than common sense - but I acknowledge that the words "reality", "common sense" and "Trump" aren't usually found together in the same sentence.

Trump’s classified documents case granted his request on Monday to postpone the deadline for a crucial court filing in the criminal proceeding, increasing the chance that any trial would be pushed past the November election. ...

 

Over and over, Judge Cannon, who was appointed by Mr. Trump, has treated seriously arguments that many, if not most, federal judges would have rejected out of hand. 

 

Often, her acceptance of Mr. Trump’s unorthodox claims have resulted in significant delays in bringing the charges in the classified documents case in front of a jury.

 

 

Prosecutor Smith has indicated that he may petition the 11th Circuit to have a new judge assigned to the case, given Cannon's continuous pattern of procedural delay.

 

Cannon seems to be daring Smith.

The New Republic: Trump Appears to Be Ditching Barron’s Graduation for a Fundraiser

Donald Trump got a day off from his hush-money trial next week after requesting to attend his son Barron’s high school graduation. But on the same day, he’s actually scheduled to attend a fundraising dinner in Minnesota.

Trump is required by New York state law to attend all of the proceedings in his hush-money trial, so his legal team had to file a motion with Judge Juan Merchan asking permission for the trial to be put on hiatus on May 17.

Merchan agreed to do so, but Trump is also scheduled to be the headline speaker at the Republican Party of Minnesota’s annual Lincoln Reagan Dinner in St. Paul that day. (Barron is graduating from Oxbridge Academy in Palm Beach, Florida.)

Trump has complained to reporters since mid-April that Merchan was not allowing him to go to his son’s graduation.

“It looks like the judge will not let me go to the graduation of my son who’s worked very, very hard and he is a great student,” Trump said outside of the courtroom three weeks ago. “It looks like the judge isn’t going to allow me to escape this scam. It’s a scam trial.”

Oh man I hate it when I finally get a day off my criminal trial but then it turns out I have to choose between attending the high school graduation for the kid my third wife gave birth to while I was f***ing a porn star who I named after a fake name I used to use when I called up talkback radio stations to praise myself on air and going to a fundraiser to pay my hundred million dollar legal bills.
