Desperate no. But I don't have a spare $30 let alone $300 so if I can get away with it then I will.

You say you don't have the money! bull crap. If your car broke down tomorrow and needed $300 worth of repairs, what would you do??? you would have to borrow some money. You already owe $28,000 dollars so whats $300.
Do the right thing and pay up!!! Life isn't fair.
Years ago i left my internet on with some torrents going, i had to pay 20 cents a mb over my limit which made the bill come to $2600.00, what did i do, i rang up Telstra, admitted it was my fault and worked out a payment plan, i didn't cry like a little baby and because i 'man' up if you would like to say they took $1600 off the bill. I put the rest on my credit card at 19.9% because i didn't have any money, it was my problem!!

What goes around, comes around!!!!

I'll try to re-iterate my main point below:

Lets turn this around so I can be a bit clearer. If I have 3rd party insurance and someone hits my car, The other person has to voluntarily file a claim with their insurance company in order for my car to get repaired.

If they don't, MY insurance company wont help at all and my only option is to take it to court which seems like a bit of a hassle just to get my bumper painted.

Stupid - what do I pay my insurance company for exactly??? In this case it makes no difference if you have 3rd party or no insurance - you still rely on the person at fault to do something or the courts... This is the hole in the system...

Your lack of understanding of the 'system' doesn't make it a hole.

The system works fine. If two parties have an altercation and they cannot work it out, then it can goto the courts. Generally one party needs to take this to the courts. This is not always the case (e.g - when the police get involved)

The fact that there are insurance companies in society to assume liability for certain types of accident, doesn't make the system broken, it just makes things more complicated so that people like you no longer understand how things work.

I really hope you get taken to small claims court, and are fleeced for everything they can claim (wasting their time, wasting the courts time, as well as the actual damages to their property that your wife caused)

I also really hope that they take it to the police, and not only do you still need to pay the courts/third party but are issued with a fine and your wife ends up with a record.

All because you are too pig headed to act as a proper member of society.

Back to the case as it is actually happening, My insurance company wont do anything until they talk to the driver at the time - my wife, and the other party as I understand has now gone overseas...

If I choose not to file a claim - because I don't LEGALLY have to, then sure the court case could be worse, but then again there is the chance it may not happen at all as well...

In this instance, you do not legally have to file a claim, sure - but you do have a legal obligation to make the third party right. Whether the police enforce this or not doesn't excuse your responsibility. If the third party decides to take you to small claims court you will suddenly find out just how legally liable you are.

My point was purely this: If you could file a claim, at no cost to yourself, to allow the other persons car to be repaired and potentially head off any court battle, why would you not?

Its not at no cost - there is excess of $300 and no claims bonus.

Maybe you'd have the money and generally be more successful in life if you had a better attitude towards others and what is right!!

Can you PM the other person details, because I would really prefer to give them legal advice. I get the feeling you are just a horrible person.

At the very least it is clear you have some serious financial challenges. Consider working with a budgeting service. They are available through citizens advice usually and free. I have heard a few stories of families who thought they had nothing and no chance of moving forward and these services can really help get some perspective and make a good plan for the future and work with you to achieve it. It is still a process and not often an instant fix, but it is the right direction instead of the wrong direction.
