No it isn't.  In fact it should be compulsory.


It is compulsory in Western Australia.  (not sure about the rest of aus, think it might be as well.)



Only 3rd party injury insurance is compulsory in WA, you pay for it with your driver's license fees - we're covered by the ACC here. 3rd party injury and property damage cover is compulsory in the UK.

Bee: My wife backed into another car today...  No damage to our car but put a scratch on the bumper and a chip in a headlight of the other car...  The other owner got a panel beater quote of $847 and says WE have to lodge the claim with OUR insurance company as her insurance company wont help - (we have full insurance and she has 3rd party)


Bee: If it was my car I would claim with my insurance company and they would sort out with the other persons insurance company - it says so on the website for my insurance company!

It wasn't out fault and we wont admit that - first rule of car crashes...

Morally I agree we should lodge the claim to help them get their car fixed but there's no legal obligation to this at all as far as I can see...

Their insurance company should sort it or else they should get a better insurance company! perhaps they dont have insurance at all?? I've no proof of things as I wasn't there and my wife didn't take any of their details...

And actually if it was our car backed into, I wouldn't worry about a little scratch at all...


I'm confused, you admitted fault on GZ, but aren't with the insurance companies??

Aside from that, if money and paying an excess is problematic, then i suggest you talk to your insurance company about organising a weekly/fortnightly payment of the excess.

Most insurance companies and banks dont want the hassle of dealing with non payment and would much rather organise a payment setup that works for both parties.

On a personal note, I think your comment of "It wasn't our fault and we wont admit that - first rule of car crashes" is really sad.  It feels like recently NZ has lost it's honesty, and now everyone is out to get away with as much as they can.  I pride myself on being honest and being fair to everyone.

I would be weary of this option. By not paying and going to court, as you are liable for the damage, you would also be liable for all the court costs and solicitors fees involved in this. This could easily see your ~$800 cost increase to ~$2000 as soon as it hits the court. This cost would increase if you do not comply with the courts orders and things like examination and attachment orders are required.

I would also be weary of assuming a figure of $10 a week. I work in payroll and have seen some attachment orders comparably large to someone's wages, nearly 20% in one case.


and if dickhead hit my car and pull this crap, i would be taking them to court and claiming all i can

New Angle : since there is no damage to my car and a scratch and chip on their car - how do I know that wasnt there already???

FYI: I was going to do the right thing and ring and talk to the other person - they said ring anytime today after 12 , I've tried 3 times and they don't answer the phone...

This aint over...

As an adult in society you have certain responsibilities face up and pay up.

Maybe you should also think about what sort of example you're setting for your kids, and that maybe you show them what be a responsible member of society is all about.

If you're a troll you're a pretty good one, the more posts I read from you the more annoying you are. Originally I thought you were just unhappy because you felt someone had inflated a quote for repairs, but you seem to be under the impression that your problems should be everyone elses problems and don't need to take responsibility for your actions.

If I  could pay it off with the insurance company I might take that option...

Times are tough - we aren't the only ones struggling I know, but companies dont make things easy for struggling families either...

Very fair question.  This is why you have an insurance company to represent your interests in this sort of case.  Your company would likely require the car to be taken to their repairer (not the other car owners choosing) where an assessment of this sort of thing is done.

I'm just working though this whole insurance process myself and I've personally found that the more reasonable you are with the company the more reasonable they are with you.

My impression is that your hard line attitude will cost you in the end. 

What impact will a court judgement have on your credit rating, just for starts?

but the insurance companies should sort this out between themselves... My wife backed into someone else and caused damage to their car - they should be able to get that fixed by their insurance company without requiring me to initiate things...

Otherwise I can just ignore it and wait for it to go away...

The law should protect the people and in this case it just doesn't...

I can understand that one.  Insurance is in case you write off someones BMW, so you just have to have it.

But many folk really pray they never actually cause a smack.

Check your policy. It may say that if you don't notify the insurance company promptly after an event that may result in a claim and let them deal with it without you trying to "cut a deal" they may decline any subsequent claim.

Don't go to court, you will just waste time and more money, the other person will win and will be awarded costs.
You then get money taking out of your payslip each week till the total amount has been paid, or if the person is sick of waiting they will enforce the order and your car could be taken.

Not worth it, call your insurance company, tell them what happen and ask for options.

I don't mean to be rude, but the more of your posts I read the more I'm wondering if you're quite a bit pissed off with your wife over this.

Trust me I can really relate with that one! 

I'm wondering why she isn't sorting this out. 

Seems to me like she should be out on the streets doing a bit more work to cover this... and don't get me wrong here dude, I'm not suggesting performing R18 favours for folk, but perhaps taking in a bit of ironing or washing (as I assume she's a stay at home mum based on what you said).

if they did have full you would now be $300 out of pockect because your insurance will be charging you your excesses, but as they do not, you can be a dickhead and make them take you to court over it - hope you get taken to the cleaner at the court.
