I am still curious to know how the judge expects the content to be removed from the Internet when the hearing is over. Should there not be some kind of basic technical competency test to protect everyone from ridiculous court orders?

A Judge is a very qualified and experienced individual, they do not get their qualification from a cereal packet. If he/she makes an order Kim Dotcom has to be able to follow that order, therefore the onus is on KDC  not the Judge.

If I were Dotcom I would forget about making a circus of it and start taking this serious.

Judges do not always make orders that can be followed - there are many examples of orders being overturned for a variety of reasons.

One recent one I read of was a man in the UK who had an order imposed on him that he was to give police 24 hours notice of his intention to have sex.

Quashed last week, I believe, as being entirely unreasonable and unworkable.

Additionally in this case, it's not KDC that has to follow it - it's the world at large recording the live stream and sticking it up all over the internet and ignoring some judge in NZ jumping up and down and saying "stop that - I said you could not do it! Stop it I say!"

It is KDC that will stream it or asked it to be streamed. The Judged has approved it with conditions, if KDC cannot be sure(which he can't) then he should not stream it and get on with it. Its just another ploy to delay.

As Baldrick said: "They say he's halfway to being the next Robin Hood. He steals from the rich, he just hasn't gotten around to giving it to the poor yet..."

Mike, everyone in the world who views that stream can make a screen copy of it and some no doubt will. There is no way Kim Dotcom or anyone else can remove it from the Internet once it has been streamed. It is a physical impossibility. A judge who makes an order like that does not understand the technology and is just making a fool of himself.

Now I get it - it's a setup. They're hoping they will be able to have another go at KDC - get him back into Court for failing to adhere to a Court direction when he fails to get the video record completely eradicated from the internet when the hearing is over.

Sometimes I just sit and think. Other times I just sit.

I never did understand the over the top Rambo-style raid with the armed commandos, helicopters and the whole shebang. Why didn't they just have an ordinary cop knock on the door in the normal way? Was this done for American reality television? Was our supposedly impartial justice system trying to suck up to Big Brother?

The dramatic raid was to shock and terrify the other big file locker outfits such as Filesonic, Fileserve, Hotfile etc.

And it worked! As within 24 hours Filesonic and Fileserve (the two most popular file lockers at the time) stopped file sharing, and within a month they closed their servers and ceased to exist. Many of the other main file lockers like Hotfile, Rapidshare etc closed not long after.

A huge amount of pirated files were deleted from the Internet as a result.

Sorry, it's your who's making a fool of yourself. No judge will hold someone in contempt of court for something they can't control. Just because someone might download the streams from KDC and then make subsequent use of it without the court being able to do something about that, it does not follow that the judge's orders are irrelevant/impossible to follow. The judge may be concerned about KDC hosting the videos on a website/medium clearly controlled by him and giving misleading clips of the hearing or whatever else. The point is that KDC cannot himself make direct use of the videos.

Do you ever disagree without taking the opportunity to deride/insult the person you are replying to ? Surely you are able to impart your take on the facts without being rude and or insulting at the same time?

Sometimes the law really is an ass. Especially when it is trying to impress the wrong people. I actually think Dotcom is entitled to an apology, and maybe damages as well.

What? He is guilty as sin. His MU site offers legit uploading facilities, but how many are going to pay to see my cat videos, selfies, home reno videos? Its all about piracy.

I do agree that the efforts by the US and NZ are stupid. Choppers etc, really stupid, but thats another thread. Guilty as sin.
