If a TV show has a smaller audience in NZ as a result of downloads, that effects the advertising rate that can be charged by the NZ network screening it.  They can't charge as much to advertisers for a lower audience.

So the network has less money.

....


The TV show wouldn't have a smaller audience if it was shown around the same time it was shown elsewhere, but since they aren't, thats how things end up.

Then you hit the next big problem - season mismatch.

The American shows typically screen between September & May.

If network programmers here schedule shows immediately after they screen in the USA, that leaves nothing for the months when weather here is at it's worst - june, july & august, and potential audiences are at their biggest (or so the argument goes..)

Seems like we need more politicians like Gareth Hughes.  I wonder how many of the more mature members of Parliament actually know what this Bill is all about?

Flippikat: Most people I know that use P2P, use it for TV shows, more than movies - just because of the long delay in getting shows here.

I can see the local networks' dilemma though  - the problem with TV shows is that in the USA especially they often take breaks of a week.. 2 weeks.. or more, for special events overseas. (Like awards shows, or sports playoffs etc).

For network programmers here, that's a problem - do you store-up episodes until you get enough to ride through these "off" weeks and screen a season in one go, or screen each episode ASAP and run the risk of  confusing the audience with seemingly random interruptions to the weekly schedule?

I recall that Prime were quite prompt in screening the last series of Doctor Who, but in the UK that series screened once a week with no weeks off.   It will be interesting to see what they do with this years 'broken in two' series with a reasonable gap between the two halves.




Mediaworks cancel  3 popular Sunday programs and the NZ Gov introduces this under urgency.  Coincidence??

Will the law target the downloading of TV shows? I would have thought it is aimed at movies, software and music primarily...

The law leaves the door open for any coyright holder (or group officially representing a copyright holder) to raise an infringement for any content, so whilst the majority of them will be music and movies (backed by the detection abilities studio's have invested in) people like Fox/NBC/HBO etc. could also raise infringements if they wanted to or could see value in it.


To be honest the current law has a huge number of holes in it, and the regulation to go alongside it hasn't been agreed at all yet with the ISP's, especially around the ability of an ISP to pass admin charges back to the copyright holders raising an issue - combine that with the incomprehensible "guilty until proven innocent" approach and you have a system ripe for abuse by the copyright holders (or those paid agents representing them).


Its also a bit ripe for people to start claiming this will make them vote Labour, it's worth noting that Labour were ready to implement a much more draconian version of this law.

I don't think they'll care whether it's made for TV movies, a blockbuster, the latest PDiddy single or a ripped version of OSX...
If it's infringing copyright, then it's in the crosshairs :-)

Anyone here in the know to clarify?

One reading states that the new amendment will include not only file sharing technology but downloading and uploading, while another source (including video above) exempts downloading (emails etc) from the bill.

Which is it...?

Are we talking here just about p2p such as torrents etc, or are we including http downloads as well? (irrespective of how hard it is to catch someone downloading http(s) compared with p2p)

Will you be putting out a statement as to how we can protect ourselves from prosecution by way of the copywright bill. My understanding is that as a account holder I am responsible for infringements that may occur by way of my account? So if I have wifi and someone manages to access illegal material I can be held responsible or I have to be able to prove I am not responsible.
