Is anyone here an expert on Constitutional law? I am not. Trump is accusing Congress of staging a 'coup'. Does he have the potential ability to create chain of command confusion by declaring a state of emergency and taking command of the armed forces? Is this even possible?

Coups and revolutions are extralegal: occur outside the law, lawless.

They're legal if you get away with it.

Extralegal is a frequent part of day-to-day justice too. For instance an attractive person is less likely to go to prison, as long as that person didn't use their looks to commit a crime, such as romantic swindles.

It's quite an interesting topic. Youtube has some discussions around extralegal factors.

Perhaps one day we'll have AI non-human judges which will make some of it moot.

But again if someone breaks the law, and no one is willing to enforce it, it's effectively legal.

Defenders of Trump would seem to be conceding that a President Kamala Harris could pressure foreign leaders to investigate Don Jr., Eric, and Ivanka Trump for corrupt business dealings.

President Donald Trump’s forceful claims that he did nothing wrong in his conversation with Ukraine’s head of state squares with his short-term political interests. But he’s setting a perilous precedent for his children.

That wrinkle struck me when I read a defense of Trump in National Review by the Republican political consultant Luke Thompson. In Thompson’s telling, the government has a compelling interest in knowing whether its private citizens are engaged in corruption abroad. Hunter Biden’s actions, he argued, create the appearance of a conflict of interest, and “anything that Hunter Biden touched that intersected, however tangentially, with the official doings and responsibilities of his father can be presumed to be a worthy subject of investigation.”

Trump is within his rights to seek information about the matter from his counterparts abroad, Thompson continued; there is nothing wrong with him “using leverage to get answers,” and Joe Biden running for office changes nothing, in part because the national interest is presumptively served by those questions, “even if they also align with Trump’s perceived political self-interest.” As Thompson put it on a National Review podcast, “Venal motives are not in and of themselves a problem.”

Finally, Rudy Giuliani’s role is legitimate, Thompson wrote in the article, though he is Trump’s personal lawyer, since “the president is entitled to designate a special representative to serve as his proxy in negotiations or fact-finding, including a personal attorney with whom he enjoys attorney-client privilege over and above traditional executive privilege.”

I do not agree with that analysis. But one must accept many, if not all, of Thompson’s premises to defend Trump against accusations of wrongdoing.

Now think of what it means to accept those premises: that there would be nothing wrong with the next Democratic president taking identical actions in turn.

North Korea has apparently successfully tested a submarine launched missile.

 

Just to recap The World's Greatest Negotiator's achievements, he inherited a situation where NK had developed crude fission bombs and had no means to deliver them.

 

Since Trump became POTUS, it looks like:

 

NK has tested a boosted fission device that can be miniaturised so that they can be delivered as payloads on short range or ballistic missiles. (they claim a "thermonuclear" bomb - but probably not really, although boosted fission uses deuterium/tritium, whatever.  Trump's got an uncle who shares his genius genes who can give the God Emperor the fine details)

 

NK has developed and successfully tested solid fuel ballistic missiles, which means that they can be hidden anywhere then mobile launched instantly, so avoiding the vulnerability of liquid fuelled missiles that can be detected and destroyed during the (relatively long and complex) fuelling procedure.

 

NK has now developed and successfully tested solid fuel submarine launched ballistic missiles.  OK, their submarines are pretty bad, but it doesn't really matter, they have plenty of them, they'll be more-or-less undetectable for long enough, and now probably nuclear capable.

 

And this is all Obama's fault  (/s)

State inspector general Steve Linick on Tuesday asked to meet with congressional staff from eight House and Senate committees to discuss and provide documents from State's acting legal adviser related to Ukraine, according to sources familiar with the matter.

The network’s internal strife offers the truest picture of how impeachment might play on the right.

There is now a growing rift on Fox: Its news side is asking increasingly tough questions of Trump, while its opinion side pushes his raving conspiracies. The drama speaks to real tension on the right, and Fox will inform political reality. It is no exaggeration to say that what happens on Fox now — the way it decides to play impeachment and the twists and turns of the 2020 race — could well determine the fate of the republic.

Fox’s anchors, reporters, its far-flung network of guests and its many shaggy narratives — what Deadspin’s David Roth has called the “Fox News Cinematic Universe” — are now deeply embedded in the operations of the United States government.

Even before the Trump era, Fox exerted striking influence on the Republican Party. But with Trump, Fox has reached the zenith of its powers. Its anchors regularly advise the president about politics and policy. Its story lines inform his hourly moods and his strategic decisions, including his staffing. And its commitment to indulging the president’s conspiracy-fueled ravings has helped pull political culture ever farther from reality.

In other words, Fox is now not just a reflection of what happens in the world; instead, how a piece of news plays on Fox determines what happens in the world.

...Suddenly Fox News feels like a nation up for grabs, and there is growing, palpable drama on its sets.

The network’s daytime anchors — people like Shep Smith and Chris Wallace, who fall on the news reporting side of Fox’s opinion-reporting divide — have always grumbled about the network’s nighttime pundits, talkers like Tucker Carlson, Sean Hannity and Laura Ingraham. Now the two sides are at open war, sniping at each other daily over the seriousness of impeachment and the very legitimacy of any inquiry of the president.

On impeachment, Fox News’s news side has been excellent. There were many moments in the last week where I felt shocked and gratified by the seriousness with which Fox was taking impeachment.

...But then I watch Fox’s opinion side and my optimism vanishes. For much of the past week, on Fox’s prime-time lineup, the president’s narrative has held total sway.

...There were times, watching Carlson and Hannity, that I felt truly terrified for the nation. Fox’s most popular hosts are still framing Trump’s political battles in apocalyptic terms; if they keep that up, what hope is there for any of us?

But this, too, is important news about America: The president, quoting a Fox News guest, says that his impeachment could bring about civil war in America. Watching Fox’s prime-time lineup, I totally believe it.

Was There Another Cover-Up In Response to the Whistle-Blower?

The Justice Department should have shared a campaign-finance investigation with the Federal Election Commission.

One of the first things new prosecutors at the Justice Department learn is that cover-ups are rarely singular. There is often a cover-up of the cover-up.

Allegations of one cover-up, then another, emerged last week. Officials in the Trump administration tried to “lock down” the phone call memo between President Trump and Volodymyr Zelensky of Ukraine (the first cover-up), and then officials in the executive branch made efforts to keep this information from reaching Congress (the second cover-up).

Now we have discovered what may be a third cover-up. In its handling of the investigation and a potential campaign-finance violation, the Department of Justice appears to have ignored a rule that a matter under investigation must be referred to the Federal Election Commission. Critically, if the department had followed the rule, the Ukraine affair would have been disclosed to the American public.
