Oh dear. Look. Im sorry I replied, as the thread was locked, I did and why. After this long, the thread is locked for an update, one might assume something new in an update, that is my definition of an update in this thread, given your sarcy reply about my definition off an update. And you did that to Quickymart as well.

Not the 54th rendition of the same question(s), which has been replied to 54 times as well.

Greg agrees with you, but his comments are well written, and he puts his opinions, concerns forward. I respect that.

I didn't read the second of your two "updates" I will do if any new updates arrive though

Heres a thought.

At anytime in the last 'few years', have you accepted a firmware update or otherwise and what were the terms and conditions of such update when you accepted it?

To your first part - no I dont recall.

No mention at all of changing my account from a Lifetime one to a Subscription or other type.

No mention at all about a limited licence

No mention at all about end of service being 31 October 2017.

And for those of you new to this thread - these are terms that apply to Hybrid. They are not terms that apply to my contract formed with Telecom - which if you look a the prevision page you will see what is covered.

Anyone wonder what Telecom was saying at the time of the Tivo Launch?

"Telecom retail CEO Alan Gourdie told a press launch this morning that TiVo would work with all broadband plans that it supplies - but dial-up users won't have the pace to use it.

"It's a bolt-on," said Gourdie, "anyone with a standard broadband package can add TiVo."

Guess who still has a broadband plan with Telecom?

Here’s a prequel (and where this all began) to the next update.

Mr Brayham adds that Telecom has a superior ability to deliver optimise the broadband-delivered content”.

Right I’m in. What’s the deal? Why should I get all this as a Telecom bundle? “One reason is financial. A TiVo set-top box will cost $920 upfront if you want to pay full whack. If you’re a Telecom Broadband customer, you get the option of buying it on tick for $30 a month”

Look how many times “Service Licence” or the like is mentioned.

And my passing thought before this thread gets locked again. If it walks like a duck, quacks like a duck and swims like a duck it probably is a duck. And it always pays to get them all lined up.

welcome to life, products actually get discontinued regularly, you've had well over 5 years use of it, i've had it since it came out in NZ. It will be missed but sersiouly spamming a thread doesn't help the matter. this thread serisouly needs to be locked its just become a joke of one person rambling

I agree. Look it's a query. Many have offered their opinions. There is NO issue if the OP doesn't agree he/she can ignore our advice and proceed with a claim. So he/she should do that. It's been discussed and the discussion surely is over?

The info page on the TiVo says:

It doesn't mention the EPG specifically. In fact the wording is pretty ambiguous all around.

I see lifetime of the service, which they've just announced they are stopping.

Knowing that this can be a charged option elsewhere, it's entirely possible that this means you've subscribed to the service without monthly fees to get it.

The only smoking gun possible here is if the sellers knew there was an end date to the service way back when they sold it. Assuming TiVo had taken off like it should had, then this would likely have been renewed, and we would have been offered newer hardware boxes to upgrade to etc over the years.

5 years isn't written in stone anywhere, but I very much suspect they've opted to end the service at that point to avoid any CGA customer comeback issues, with that length of time likely to satisfy the reasonable length of time clause wording. I also suspect the 2017 end date was decided upon based upon this criteria being satisfied, and wasn't necessarily set at that date right at the commencement of TiVo services in NZ way back in the day. So the smoking gun mentioned above may not exist.

Nailed it. It's not a conspiracy it was a great option that many loved but it didn't survive.

Someone or a company could take it onboard. TVNZ for example. Revive it. But no word

I'm thinking i should change the topic heading. CGA is perhaps to dramatic when a simple warranty claim will suffice.

Any way, just out of interest (because these things interest me as much as anything else), I've found the following. I know some of this is self evident but I like to find my own information rather than just relying on internet forum posts. So......

Tivo essentially sells two subscriptions. On is a "periodic" one. ie an annual subscription to the service or back in 2008 they introduced Product life time. It is now known as All-In-One.

Tivo formed a relationship with TVNZ

A requirement of having a relationship with Tivo is to report back the subscription base.

Lifetime (edit) Subscriptions is "life of the box" not life of the subscriber. So you can sell your box to another person and they get the benefit of that subscription until the box dies. Death does not include hard drives etc if you choose to replace these. Its essentially when the ID chip dies as thats not replaceable. Death is also when the box stops talking to the Tivo server for more than six months.

Subscriptions are a key Tivo metric - this means the reporting of subscriptions has to be accurate. Revenue form lifetime subscriptions get amortised of 60 months - after which no revenue gets booked. But the life time remains.

In NZ Tivo was sold with no ongoing periodic payments for its subscription. There was no indication it was an Annual or other periodic subscription.

There are two clues on the Tivo box that it was sold with a Lifetime of the Box subscription.

My tivo currently does not have a defect so I thought it would be courteous to let Spark know of the potential defect - that being the likely failure to provide features paid for. They wanted me to get in touch with Hybrid. I've told them no one is around at hybrid anymore. They say they no longer support Tivo (of course - we can agree on that). They have no person or department who looks after warranties - warranties on any thing. (so if you want to make a warranty claim on your phone looks like you are tough out of luck). So it seems I cant reject the tivo. Part way through the conversation Spark simply hung up.

So I might just let it lie now until the Tivo does actually develop its defect and lodge the warranty claim then. That said the box may die before then and obviously I wouldn't have a claim at that point - it wouldn't be worth my while getting it looked at and repaired if it was a small fault.

You can't have a warranty claim on a five year old hardware that has one or two warranty, surely?

@freitasm why is the unlocked again? the OP has again posted nothing of quantity nor have they even so it seems attempted to go along the route of making any form of claim against anyone. they are just repeating stuff over and over

they have all the details and information so there really is nothing left for them to post except for the outcome of any claim they make, if they even make one in the first place.

The warranty would have long expired.
IANAL but IMO warranties are somewhat irrelevent in NZ for consumer use, unless they are providing a benefit over the CGA.
