Stuff: Lime e-scooters have been pulled from Auckland streets for now due to a software glitch that causes the wheels to lock up.

Auckland Council chief operating officer Dean Kimpton confirmed on Friday that Auckland Council and Auckland Transport had decided to "temporarily suspend" the e-scooter trial in the region due to safety concerns.

The suspension would be reviewed on Monday.

This surprises me Lime did not make the decision themselves earlier.

Lime don't strike me as the most ethically concerned group. I get the feeling safety is lower on their priority list than say.. Money... :)

It's the Uber of Scooters :)

And they have the financial backing of Uber too, actually.

Their launch model is the same - "dump scooters on the road, don't talk to local government, if local government complains then raise middle finger and use public as human shield against legal penalties". Worked on the Brisbane City Council. Didn't work so well on Gold Coast City Council who responded with "dump scooters on our footpaths, we'll impound them all and charge you with dumping offences".

I want these measures

1. Helmets

2. Footpath is allowed at a low speed, not sure yet what that is, maybe 10k thats only 2 x walking speed. Everyone else has right of way

3. Cycle lane is ok

4. Road is ok

MUST be enforced.

2. There are footpaths and there are footpaths. 10kmph is ok in the CBD crowded with pedestrians of if the footpaths are poor quality. 10kmph is painfully slow on long, empty stretches of wide footpaths. 18km would be my pick but that's not far off 20km and at 20km you're not far off 25km which is the max anyway (without circumventing these limits).

It's all relatively, sometimes 15km feels really fast, other times 25km is still too slow. And that also applies to the observer so imagine how you would enforce the speed limits - you can't use judgement. Radar guns?

Well they talk with the councils first, and try to get them on board, but if they're being difficult they do it anyway, and be like "We'll show you how this can work"

And then, once the public are in love with the service, you can't just take it away from them

No, they really don't. Queensland's state government literally rushed a law change through just to make Lime scooters legal because Lime didn't talk to them before announcing a launch date. That's how bad their attitude to law is.

Given it uses the imperative "must" one could assume there's something behind it; whether or not that involves the ability to issue fines is another matter (is it simply based on general rules in relation to the use of the footpath)?

The declaration' in relation to e-scooters linked to from that page is simply to define certain ones (those under a certain power output) as 'not motor vehicles'; that has a potential impact on grunty scooters like some in the Zero range, but I assume was necessary to ensure they weren't required to meet the conditions and requirements of being considered a 'motor vehicle'.

What the NZTA have published is essentially 'policy', it's not something [yet] proscribed in law. There are therefore no specific sanctions. If riders are being reckless through pedestrians, i.e. riding at high speed, not giving way etc., potentially section 13 of the Summary Offences Act 1981 could come into play but this is not 'handing out a fine' it's a court appearance so the rider would have to be arrested/bailed or summonsed, which is unlikely. If police turned up to a call for such a matter or just happened to be present, they'd most probably dish out some sort of warning, whether it be verbal or a formal written warning or, if it was more serious, perhaps a pre-charge warning.

Hammerer: Is there something that says electric scooters aren't covered by the laws and bylaws?

I thought that the existing legislation already covers electric scooters as vehicles just as it has always covered the push scooter that I've used.

Section 2 of the Land Transport Act 1998

means a contrivance equipped with wheels, tracks, or revolving runners on which it moves or is moved

I've seen police move skateboard (specifically mentioned in the Act) users and scooter (not specifically mentioned in the Act) users off the road because of they represented a danger there.

The gazette link posted jonathan18 a few posts above yours details that an e-scooter is not a motor vehicle.

If they are going to put a speed limit on the scooters in name of safety, I look forward to the speed limiters being put on car too.

Legal limits 100km so limit top speed of cars to 100km. Wont happen though.

Has anyone here experienced this 'glitch'? As someone mentioned on here previously, the brakes are pretty average, I don't understand how you could get thrown as a result. Is it a different brake being activated than the handlebar lever??

Could the drive motor "lock up" enough to overcome inertia to cause this? Rather than the brake?

I wondered that, given it's the front wheel driving it would make sense to be the case. Just curious though.
