BigHammer: Warehouse Stationery have chosen to break their contact and not supply the item as agreed when they took my money.

Not impressed.


Have they contacted you to say that? or is that an assumption?

BigMal: Yeah 3 guys here at work missed out.  It's a bit dodgy that Warehouse Stationery put "limited to 100 units" later on in the day.


Mine says 'shipped' with a track&trace number but several guys still showing as 'in process' which I'm starting to think is going to mean a couple of unfulfilled orders :(

No assumption. Why would I make that statement of it wasn't fact? I received an email from Warehouse Stationery.

What was the reason for cancellation? I notice they have them in stock at full price now

Surely if that is the case then they have no reason for cancelling orders taken on Friday. If they took the order meaning that they sold more than they'd planned, then it's their error. They've agreed to the sale, taken the buyer's money. If they have stock then surely they HAVE to complete their side of the contract of sale.

Showing out of stock on their website.

Just checked mine and it seems it has been delivered to the store I picked, just waiting for the call now, otherwise i will call in on the way home.

According to the CGA....

Availability of goods and services
Traders must not offer to sell goods or services that they do not reasonably believe they will be able to supply on the terms offered.
Traders must provide clear and accurate information to consumers about the availability of goods and services and when the consumer can expect to receive them.


If you consider they didn't add the "Limited to 100 units" blurb until Friday afternoon then is it safe to say they breached the CGA?
