Aug 16 (Reuters) - A Georgia state law against racketeering could be a powerful tool in prosecuting Donald Trump, but applying charges traditionally used to take down organized crime risks miring the case in legal and logistical complications.

 

Fulton County District Attorney Fani Willis on Monday charged the Republican former president and 18 associates ... all are accused of running afoul of the state's Racketeer Influenced and Corrupt Organizations, or RICO, law.

 

You can tell a great story in your indictment, and you might be able to prove it. But you also might be making it more complicated,” said former federal prosecutor Harry Sandick.

 

Experienced lawyers expect the case to almost certainly be delayed due to the sheer number of defendants, each of whom is likely to raise a unique set of pre-trial issues.

 

The problem with RICO is that it takes a lot longer because there are so many more elements to it,” said Jerry Froelich, a Georgia criminal defense attorney and former prosecutor. “I don’t know if you could even find a courtroom big enough for 19 defendants.”

 

The unprecedented nature of the case could work in Trump's favor, allowing his lawyers to argue it is inappropriate to charge a former U.S. president and his allies like gang members.

I'm dying to see what this "report" of his around the "election fraud" he still believes happened in 2020 actually says, but my interest is purely for the lols.

 

As I saw somewhere yesterday, a Republican said the more they talk about 2020, the less it's a winning strategy for them - if they keep harping on about the past (ie, 2020) they're sure to lose. True to form, Trump is busy being a broken record on exactly that.

Both of those are good points, RICO trials take forever and if you're white and rich you can legitimately make the second argument. Black/Hispanic and poor and it won't work.

 

 

For people who aren't familiar with how badly RICO gets abused in the US and the appalling miscarriages of justice it's led to, here's a typical rundown:

 

 

* Sheriff's department gets told it has to bring in $1M each year in RICO asset seizures.

 

 

* Department can either go after organised crime, which takes a lot of work and they have lawyers, guns, and money, or after random people who can't fight back much. Examples are Hispanic (used) agricultural equipment buyers who travel with cash for cash-only sales, a black cleaning lady who was retiring from NY to somewhere warmer and carrying a bank cheque to pay for her house, etc. There's a neverending string of these, those are just two I remember. It's virtually never white people that get targeted.

 

 

* These people shouldn't have this much money so you seize it on that basis and then they have to spend years in court trying to get it back. Oh, except that you've taken all their money so they can't afford to do that.

 

 

It also leads to bizarre cases like "United States vs. 123 Washington St, Florida" which is what they're seizing. In effect RICO is used like letters of marque by US sheriff's departments.

The whole concept of sheriff is really messed up. They're numerous and widely ranged.

But that's a topic for another day.

For Trump, the RICO case is a no-win situation. Generally Americans don't know what these next two items are, but they know they're bad: socialism and racketeering.

Before the 60th quadrennial presidential election, 5 November, 2024: Trump will having a constant stream of racketeering news.

After the election, if Trump was found guilty, no one can pardon him
  • Presidents can't pardon state crimes
  • The Georgia governor can't pardon, by Georgia law, for 5 years.
  • Whether a president can pardon himself, doesn't matter
If President Trump wins: if the Georgia state case is ongoing, he can't stop it; they are not under the federal justice system.

This assumes the case goes ahead, which seems it's unstoppable now.

The Washington Post - Georgia prosecutor seeks March trial date in Trump election case

ATLANTA - An Atlanta-area prosecutor is seeking a March trial date in the criminal racketeering case against former president Donald Trump and 18 others.

 

In a court motion filed Wednesday in Fulton County Superior Court, Fulton County District Attorney Fani T. Willis (D) sought a March 4 trial date. 

 

She also proposed individual arraignment hearings for each of the defendants sometime during the week of Sept. 5, as well as a schedule that she said would not conflict with Trump’s other pending criminal cases *.

 

 

*  This proposed trial date probably conflicts with the Stormy Daniels case, scheduled for March 25 in New York.  The Georgia trial could easily take several months.
