We will assume that gestation is +/- 40 weeks, therefore you are suggesting that terminations occur at 36 weeks. In NZ terminations are carried out up to 20 weeks. It can be done after that time in exceptional circumstances prescribed by law.

Well I'd just turn it around again to say that if abortion laws were fair and just, then the possibility of unlicensed and potentially unsafe (aka "backstreet") abortions being carried out would be eliminated anyway - and there's no need for specific legislation covering harm by carrying out unsafe abortion compared to carrying out any other medical procedure which could result in harm if carried out by unqualified idiots.

 

There is a problem with the NZ law the way it is.  Doctors are routinely interpreting the law re preserving the mental health of the woman to determine that an abortion is warranted, and that potentially places doctors in a difficult legal position.  We do have de-facto abortion on demand and should stop pretending that we don't - in order to keep a few religious zealots - mainly men - happy.

 

 

I can think of circumstances (mainly cultural) where despite abortion being overtly legal, some women might seek out clandestine providers.  There is also the risk of women being coerced by partners or family members - which the current system attempts to detect and address.

 

Your second paragraph I agree with - apart from the generalisation it ends on.  Legitimising the current practice makes sense and could be achieved with changes to the Contraception Abortion and Sterilisation Act.

 

I would still want to see unregistered practitioners captured by the crimes act.  Possibly this could be achieved by treating abortion as a type of surgery.  I'm not sure.  On balance, I favour keeping the crimes act as is and changing the other act.

An unqualified "backyard" person performed any surgery or procedure which resulted in severe medical misadventure or even death, should certainly be penalized under the crimes act, whether it be a tooth extraction or an abortion.

Due to routine ultrasound missing a rare and lethal congenital condition, an ex of mine had one of the >20 weeks procedures.  This is actually foetal-euthanasia via alcohol injection followed by induced delivery.  We were both very young at the time.  Pretty sealed harrowing.
