crazed: Effectively they haven't breeched the T&C's of the plan.

Lets review the points of interest of the Bigtime Plan.

  • Its Traffic managed, particulaly P2P Traffic. They could effectively manage it down to 33.6k modem speeds and still be within the terms of the plan.

  • There is no guarantee's of transfer speeds at all. NZ ISP's Don't guarantee Connection Speeds.

  • Plan is stated as being Fullspeed within the capablity of your line.

  • You agreed to the Traffic management when you signed up for the plan. You have the right to change plans once free of charge per month if you aren't happy with the speed.

Your only real come back against Telecom would be possibly that the connection isn't suited for the purpose that it was advertised or provided. Good luck in proving that one.

Telecom has stated that you can have unmetered all you can eat bandwidth in return for traffic management, you are paying $60 for that service. Thats $20 cheaper than the 40Gb plan without traffic management. They tell you when you sign up for the plan, "That the plan is Traffic managed and is not suitable for everyone."

You can either have Full unrestricted speed and pay for bandwidth or managed speed(based on Network load) and unrestricted bandwidth, You can't have both on this plan. If you believe you have a fault, then ring 120 or what ever it is and log it as a fault and see what comes back.

I'm afriad, I can't see how or where they have breeched the T&C's?

They've breached terms and conditions by creating a service which is virtually unusable as a BROADBAND connection 24/7.

Yes its Broadband based on your connection speed to the exchange. I get 7mb down and 600kb up consistant, after 4pm in the afternoon I get huge issues with speeds, but my connection is still around 7mb down and 600kb up, therefore its still a broadband connection under the definition of Broadband.

Yes we agreed to traffic management when we signed up for the plan but not an artificial cap on all traffic. If traffic was actually being managed then you would expect speeds to fluctuate during busy and slow periods, as is what happened prior to about 1 week ago. At the moment speeds are the same all of time whether it's off peak or not and worst of all it's http traffic as well. Telecoms T&C clearly says they will not put a cap on speeds.

your right we manage all the traffic on Big Time
No fixed data caps

Traffic Management - We don't place an artificial cap on the download or upload speed

good luck with that, you wont get far at all. Your call will be put through to the phillipines, from there its near on impossible to be put through to level2, you can get called back by level2 but this can take a while.
And even when you do get to talk to level2, its no use anyway, they have NO IDEA whats going on, as people have stated they are all being told different things.
Im reluctantly starting to beleive this is BigTime, and is what we can expect from now on.

Try Posting the whole statement in the correct context:

Traffic Management - We don't place an artificial cap on the download or upload speed on the majority of the internet activity our customers have on this plan. But because it has no fixed data allowance, we do manage all the traffic on it to optimise the experience for everyone on the plan. When the network is busy (generally inside the hours of 9am and 2am) you may notice reduced speeds, in particular you are likely to see reduced speeds in relation to file sharing traffic and online gaming.

Yes and at the moment all international traffic apart from maybe one or two websites has a cap on it. That sounds like more than a majority of traffic to me. And as i said before if traffic was only being managed you would expect speeds to vary which they don't.

As I have said before. If they breach the law, which they have pretty much have done
Then the law overrides their T&Cs regardless of what we agreed too

You would be surprised, Youtube streaming for example is a huge % of total traffic.

But I'll agree with you, normal international HTTP browsing being capped would be very annoying.

Whyt bother wasting your time?

Just ring another ISP and change. You'll then have fast internet again.
