As I have said before. If they breach the law, which they have pretty much have done
Then the law overrides their T&Cs regardless of what we agreed too

Yes the Law of the Land overrides the T&C's, but how have they broken the law?

There must be something in the Consumer Guarantees Act or contract law that says you can't violate your T&S. I am going to call the Commerce Commission to see if they have had any other complaints and encourage everyone to do the same.

How many people signed a 12 month contract with Telecom?

How much is the disconnection fee to begin even considering swapping ISP's?

Are there any ISP's in New Zealand that do not have ANY issues surrounding their broadband?

this is a slap in the face!

I signed up with telecom on a 12month contract. It is $199 for me to break it Undecided. If it wasnt so steep i would have already.

Bottom line is this thread isn't going anywhere fast, just going around in circles with the whole breaking the law vs not breaking the law.

If you think its breaking the law then why isn't anything being done about it? i may be mistaken but there seems to be alot of accusations and no action.

Well I've already quoted one section of the Consumer Guarantees Act and someone else has quoted a couple other sections in the CGA and Fair Trading Act...

Plenty. The issue comes down to how much you're willing to pay.

If you're with a fibre provider you can get guaranteed bandwidth, such as 4Mbps pipe with a 20GB cap for probably somewhere in the vicinity of $500 per month. Likewise you could probably get an ADSL provider to guarantee 1Mbps performance with unlimited data for a similar amount.

I have looked and as I have said previously I don't see how they have broken the law or breached their T&C's, if you think so highly that they have, by all means take it further.

I just dont think they have.

Kind of a shame really, this plan used to be great for our households needs, the great part was the phone + broadband bundle for a great price.

To switch ISP I will require $199 to break with Telecom, keep my existing phone line (not sure how much this costs monthly) and around $89.95 - $99.95 per month for a plan with a 60GB allowance.

Starts to get a tad pricey.

I do hope that Telecom can find some middle ground with their experiment as this was a great plan for months.
