it looked like that to me initially as well, but it turns out the video accurately represents Bigtime TODAY. The written T&Cs leave us scope to manage traffic whenever necessary however.

I am not disputing that. Remember I was in the conference call Big Time was announced and asked those questions. But mixed messages are bad. That's all.

Fair comment... Here's the accurate interpretation...

Having spoken to the PM who authorises changes to the traffic management, there is currently no authorised Bigtime traffic management between 2am and 9am. There may be other reasons why performance during that window might not be as fast as people may wish for, but it shouldn't be the Bigtime traffic management policy.

The over-riding statement from the text of the Bigtime T&Cs though is that Telecom MAY shape any traffic at any time. We simply have to have that catch-all after the GoLarge problems.

So the video is correct at the moment, Traffic Management doesn't apply from 2am-9am.

In practice...

Http(s) downloads from Rapidshare, Megaupload, Hotfile appear to be shaped 24x7.  I believe previously in this thread Doozy said they do not have an effective/reliable way to unshape this after hours.

Torrents certainly speed up after 2am though.

Will we ever see any kind of honesty, openness and timely status updates from Telecom or perhaps some other ISP willing to innovate?

BUT you have to realise that other ISP's are ALL limited by the wholesale offering provided to them by Telecom. If the wholesale offering does not have enough 'meat' in it to offer a truly great Broadband plan, then we will never see one. This is if my understanding of the current system in NZ is correct...I have never gotten a clear answer about it from anyone.

Think of all other ISP's in NZ (other than Xtra) as 'Dealers' for Telecom's Broadband service. There is limited scope for improvement thus why there is such a dearth of options in NZ at present.

In Europe and the USA competition is FIERCE in the broadband space (mainly due to more open competition and increased populations/economies of scale) thus why they have a myriad of good and CHEAP Broadband options.

NZ and AU will take a LONG time to come up to those levels (if ever) due to proximity and population limitations. It is just one of the added 'costs' of living in a clean and green country where planes are not flying into buildings etc...

At 2am, the shaping definitely comes off, as mentioned in the video, the only reason the T&C's are as they are is a "reserve the right" type situation, lets say, tomorrow the peak in BB traffic moved to 2am, I'm sure you can imagine we would want to revisit the hours of shaping (and update the video).

But it could be argued that the specific representation that Telecom gave in regards to there being no off-peak traffic management is also part of any contract the user has with Telecom As the courts, when faced with situatiosn where there is conflicts in the interpretation of contractual agreements, will usually side with the consumer who doesn't have legal personal on staff that Telecom does so is in the weaker position. So I wouldn't rely on the T&Cs as a basis for introducing management in the off peak hours. Not that I'm saying you are considering this, just a note :)

But this is getting way off topic :)

Any word on when the problems of the past few weeks will be resolved, and why there is no note of it on the status page? Was getting 8.5% usual speed when I tried at 5:30am this morning :(

I've been out of the office for a week (just back this morning), so wading through all the emails relating to this trying to build a timeline of what has happened and what (if anything is due to happen).  I believe I have an official update meeting in the morning

I am on big time and finding the variance is quite mind boggling.

Some downloads are rapid and others are lousy. I can watch TV3 on demand no problem yet TV2 is a waste of time.

Most likely not as then people would be able to use encrypted connections to get past the throttling

I think it's the classic case of people not knowing the difference between "MB" and "Mb" - the developer probably doesn't know and just put everything as "MB".

In that particular case, the figure at the top is a moving average for the individual file, while the figure at the bottom is an instantaneous figure. Even on an unconstrained line, DTA reports wildly varying figures for the bottom instantaneous figure.

Using this ( http://www.metal-machine.de/readerror/ ) is a much better way of seeing what your connection is doing... (Note it's an eth port monitor so if you are doing any file copying etc it will reflect that too)
