i got a knock at my door from a telstraclear rep trying to sell me cheaper toll calls and when i told him i do not make toll calls he talked to me about broadband. he asked me who i am with and i said xtra. he said to me 'you know how xtra have slow speeds sometimes" and i said yes and he said he can guarantee me fast speeds all the time with telstraclear.
 
i didn't sign up because i said i was not interested but if this is how telstraclear is selling it's broadband to people then that is just wrong. no isp can guarantee you fast speeds all the time because it depends on distance from the exchange and congestion on their network. i wish i recorded him on my cell phone but i didn't have my phone on me.

If you're talking about TCL's own cable network then they can guarantee the speeds. If you're talking about ADSL then TCL have come out tops with their own ADSL network and for end user consumer connections over Telecom lines in recent surveys.

there is no telstra cable network in my area.

so when you sign up to telstraclear adsl does their terms and conditions say they guarantee fast speeds? if it does say they guarantee fast speeds will i get some credit on my bill if the speeds are slow on some days?

business plans may have some guarantee of latency and uptime percentages, but i've not seen this kind of thing on a residential adsl plan before.  cable is a different story though.

The reality is that Telstraclear like most networks have slower speeds at times, a lot of providers do - particularly when you are dealing with high contention rates. Given technologies such as DSL, its difficult to state 'you will get 7.6mbps' as there are line conditions, exchange backhaul, or ISP backhauls (becoming more common nowdays as internet providers oversell their capacity)  which all affect your speed.

If the issue is a line issue (this is the most common factor) or an exchange issue (becoming less and less common), then changing internet provider will not improve the speeds. Though, if they want to overpromise their services (anything to get a sale?), I guess there is room for them under the fair trading act or CGA.

Many providers offer plans with better SLA's for performance and uptime. However the price tends to go up to match the level of commitment you are after.
