Hi guys,

Hopefully GZ has a legal boffin or two online who can give me some advice...

I got a ticket recently for parking on the road without current rego and I have just noticed that the warden wrote the wrong street on the ticket The ticket says i was parked in Conway Street but i was actually parked in the next street over.

Without implicating myself by pointing out the correct street to them, does anyone know if this is grounds to challenge the ticket? Should I ask them to supply evidence that my vehicle was in fact parked where they claim? Because it definitely wasn't and if the warden has taken a decent enough photo of the car and it's surrounds, I should easily be able to prove that the photo was not taken where they claim it was.

If I can prove that the car was parked in a different location at the time of the ticket, can I get off, or will they just reissue the ticket with the correct street name?

I have always thought it is a joke that they sting you for no rego, but then when you do rereg it they back date the reg to cover the period you received the ticket.

At this point it's probably your word against theirs unless you still have your original pay and display ticket.

Without wanting to incriminate anyone I know either, the way to handle that is to go to the website and pay for a new rego while standing next to your car, having just found the infringement notice... 'Bbbbbut I paid for the rego on the same day, and it just hadn't arrived in the mail yet!'

I take it however that is no longer an option.

I once received a ticket with the wrong rego plate details. The officer had hand written the letter "N" on the rego plate in such a way that when I received the typed notice a few days later the plate detail was typed up as LW1234 instead of LN1234.

I simply wrote to them and said that I totally deny having been speeding in a Mazda Rego LW1234.

I guess they would have looked up the car with rego LW1234 and seen that it wasnt a Mazda. I was let off. I certainly didn't tell them what the correct rego plate was!!

You could try the same thing - don't state the street where the your car was ticketed, just deny having been parked in the street where they give the wrong street name!

I was just parked on a suburban street so you are probably right. I really hope the warden took a photo as they usually do these days. I could then restage the car and take another photo with the same background and geotag it to show they had the wrong details. I can then argue that if they got one detail wrong, are all the other details on the ticket also wrong?

How recently? Assuming you are in Christchurch they do leave a slim window of opportunity.

"If I re-register my car straight away after I received a parking ticket will the fine be waived?There are a number of conditions that must be met before consideration will be given for the ticket to be waived:

The period of expiry of the licence label displayed at the time an infringement notice was issued is less than one calendar month.
A new licence label was obtained within two working days of the notice being issued.
This was your first infringement notice for this, or similar type, of offence, or the first offence notice issued to the vehicle while in your ownership.

All motor vehicles on the road must display a current annual licence label. This includes vehicles that are not running."

Not recent enough by the sound of it. The rego was out by less than a calendar month, but the ticket was issued early last week, so that will not work as I am past the 2 working days.

That would have been handy info to know at the time tho. Why is this not printed on the back of the ticket? Oh yea, I guess it goes against their revenue gathering principles to tell people up front that they have time to comply.

It looks like the "My car was never parked there" defence is still my best option at this point.

The question that begs asking is why your vehicle was on a road, any road, when it was not currently licensed? That being said if you alert them to the fact that something is not right they are within their rights to correct it. Best option might be to wait for the reminder notice and at the lastest opportunity deny liablility and have the matter heard in court.

I wouldn't go that far. It's only Monday, You have to relicence any way so see if they'll let it go. Keep driving and there's no chance of getting off multiple tickets.

I'm with Martyyn pay up you broke the law and have admitted as such.

At the end of the day they know it wasn't registered and if you say it was in another street its still illegal.

Why do we spend so much time not accepting responsibility for our actions.

There's no fun in taking it on the chin! The fact is my car was not where they claim it was. So if it wasn't there it could have been anywhere, including my driveway. I would happily have already paid the ticket if it were correct. the legalities of what I did or didn't do are not the topic here, only whether the ticket having incorrect information on it is enough to get it waived.

Personally I blame the wife for not telling me it was overdue as she is the one who drives that car (and opens all the mail), but that doesn't change that the ticket itself is incorrect.

I agree. pay your fine. You admitting guilt anyway.

Everyone else pays their licence fees and WOF's. Why do you feel that you deserve to be let off because of an incorrect street?

Its simple for the council the check if the car had a valid wof/rego at the time of the ticket. Proving you were parked in a different steet (still council space) will mean nothing. So unless you are able to prove that the car was not in council space at the time of the ticket (you already admitted it was), I don't think there are any grounds for them to let you off.

These tickets are normally for failing to display a WOF/rego label. So even if you went straight away and got a new rego, the ticket would probably still be valid.

Im stoked that councils are actually starting to fine people for this. I see many cars on our roads with expired wof's/regos or both. Its always irritated me that some people just don't care. I was involved in a crash once where the guy that ran into me had no WOF/rego and insurance. His car was far from roadworthy and should have not been on the road in the first place.

Pay your fine. Dont drive around without a rego.

Given the choice of blaming my wife, or paying the ticket (regardless of the amount) I know which I would choose - and it involves opening my wallet!!!

Given the choice of blaming my wife, or paying the ticket (regardless of the amount) I know which I would choose - and it involves opening my wallet!!!

We have both our cars registered on www.carjam.co.nz
Get an email a few weeks before they expire. Works really well.
