There needs to be more done about the use of phones while driving. We have a SUV so can see into cars easily, one of my sons drives a truck and has a better view. The number of drivers we see talking and holding phones or texting is alarming, many of which are not driving at all well while doing so. The message just is not getting through.

Agreed. The penalties are not harsh enough. That goes for speeding and other driving offences as well.

I see people on their phones every day on my evening crawl down the motorway. Anecdotally, usually tradies actually on their phones. Probably a lot more people texting etc. that I can't see.

The penalties for these will only work after the first time you get caught. Until then they are not a deterrent.

No one thinks of the penalties when they answer the phone or make a txt as using your phone at anytime and any place is now the norm.

And how exactly is the phone supposed to magically know that you're driving?

It could be done, we were trying to pair my new phone with my wifes' Skoda and it would not let us do it while the car was moving. So if a car infotainment system can do so could a phone.

But what about passengers in the car who want to use their phones? Bus and train passengers as well?

The phone could know if it is moving fast, but can't know whether you are the driver.

I imagine GPS can tell if the phone is travelling at a speed beyond the capabilities of a pedestrian.

The phone asks "are you the driver?". If you answer no and you were the driver then all responsibility lands on the driver.

It's already the drivers responsibility.

If I was looking at a paper map (back when those were a thing) and crashed as result of not having my eyes on the road, do you sue the map company?

Depends on how big they are or if they are a subsidiary of a bigger company.

A lot of time in US you will sue the biggest one you can and hope they settle out of court

I hope nothing comes from this. It will be like that bs warning on phones when you want to turn it up about hearing loss. "Looks like you're moving. Don't use when you're driving" and an OK button or something would be the effectively useless and annoying outcome of something like this.
