IANAL. I looked at their world warranty, and it does say that inbox 'accessories' have a 6 month warranty. ..... manufacturers warranties can't override the CGA.

That's the point right there. It doesn't matter what the manufacturer says the warranty is, the product still has to be durable and free from minor defects.

I've got my gander up!

not to be a pedant but the term is normally dander in that phrase meaning Anger or Vexation

Not gander which is a Male goose  or having a look at something

As regards the stylus if the advertising makes it to be a major part of the whole phone experience, then i'd say give it a go with trying to get a replacement, the thing is its a cheap item relatively speaking and they do wear out, if it was a dearer item i'd push it, but to be fair the replacement cost isn't excessive

Maybe I did actually wake up my male goose to get involved... But no, you're right, it should have been dander.

So i cant understand why samsung is saying it has a 6 month warranty. If its an accessory/consumable it should still have a reasonable life expectation (more than 6 months)

But as its a consumable its not worth the effort - just buy a new one.

IANAL. I looked at their world warranty, and it does say that inbox 'accessories' have a 6 month warranty. However one could argue that the pen is an essential part and characteristic of this particular device over other device, and when you get it, it is already installed in the device. So prior to reading that, I thought it was covered by their normal 24 month warranty on the device.  So not separate as an accessory like the headphones. They probably need to make that more clear when people are buying these. Plus manufacturers warranties can't override the CGA.   It is a lot cheaper for the manufacturer to replace it than the consumer, as it would possibly only be a few dollars cost price for the manufacturer, while in NZ, it looks to be about $50 if the consumer was to buy it in NZ. Vs $US15 in the US. We seem to pay a lot more for these types of things here. \I am wondering what would have happened if the pen was stuck on the phone, because you do need the clicky end thing to pull it out of the slot. Would it be covered by warranty if you couldn't get it out of of the phone, because the clicky end has come off? Mine does seem pretty flimsy for what it is, probably would have been better to make it out of metal.

That's exactly my reasoning.  An accessory is something which is additional to the device.  If the item is quite literally incorporated into the body, then it's not an accessory, it's part of the phone.

What happened is exactly what you describe - the "clicky end" button came off when I was pulling it out.  I was fortunate that the stylus moved a few millimetres when it happened, and I was able to get it out the whole way.  But once that end has come off, there's no way you can use it as intended.

I sent off the proof of purchase and photo of the fault to Samsung.  Will wait to see what they say.

As noted above

A consumable or high wear item wont be covered (via CGA) for as long as the main product .
Want a CGA claim, prove its not a consumable or high wear item .

The fact it was packaged with the ph is irrelevant .
Laser printer drum units are part of the printer package, yet not expected to have the same warranty as the printer

How much is your time worth, is it really worth getting worked up over & spending a lot of time trying to force a warranty claim .

Laser printer cartridge it a very different example. It's clearly something that gets used up, and the manufacturer normally provides an estimate of the expected life (pages) before it needs to be replaced. If the phone manufacturer provided the same info about a stylus (i.e. it is supposed to be replaced every six months) then it would be considered a consumable.

If it is a high wear item and it doesn't last, then it's just failed the durability requirement.

Isn't the drum of a laser printer usually in the toner? So when the toner is switched, so is the drum? But a printer is a very poor example, because a 'consumer' is not likely to be printing off huge quantities of printing for the drum to be an issue. Printers do have also have duty cycles and most seem to know the number of pages. I have never had a problem with the drum of the lasers I have owned. Plus consumer ones are very cheap these days, you can get laser printers for between 50-100 on special. Whereas phones are very expensive.

brother in law had a Dell laptop and one of the keys were not working, Dell replaced the entire keyboard.

now i don't exactly know what is broken, maybe a diagram or pic to explain? is it the stylus broken or the phone insert hole that's broken?

Depends on the printer. On smaller units, the drum/toner is in one package, on larger printers they are two separate items.

Referring to the printer example, if the nib wore out, and that was the issue, then the analogy would apply.  But applying the same analogy, a part on the toner cartridge has broken off and the rest of the toner can't be used.

And reinforcing this idea, Samsung do provide spare nibs, and I have replaced one that was getting a bit worn.  If there is a part which is "consumable", surely it's the nib not the stylus itself?

To use another analogy, I would expect a warranty of more than a few months to apply to a Parker pen, but wouldn't expect the ink refill to be guaranteed for many years.

As you can see from the image above, the fault is that the casing of the stylus has fractured around the point where the clicky button sits.  If the normal use of the stylus creates so much wear around that joint that it fails before the phone does, then I would contend it's a manufacturer fault, not wear and tear/consumable.

Did samsung say it want covered because it was a 'consumable' or an 'accessory'? The nibs would be a consumable, but he pen I would either consider to be part of the phone itself, or an accessory. IANAL, but IMO accessories should last longer than 6 months IMO under the CGA, as goods are required to be durable under normal consumer use. I remember I purchased a tool from Dick Smiths years ago before it closed down in NZ, and it broke after about 7 month. I took it back to the store and was told that they only provide 6 month warranties on that brand of tool. I asked for it to be replaced under the CGA and they did.

its 23 months old.

how many times is it in and out of the holder a day?

is the phone usable with out the stylus? IMO if thats the case then its an accessory which expands the experience and while it may be considered integral to the phone its still an accessory and not required for use.

The only reason to buy a Note is for the Stylus. There are far cheaper phones with equal specifications that don't have it, so without the Stylus it's another expensive Android phone. Therefore it's not an accessory. It's the defining feature of a note device, core to it's intended operation. If you don't need a note, you could get a S10+  $300+ cheaper.

maybe so but how many time does the stylus get removed on average per day? over 23 months?

23 months is not ba bad innings and within the rhelm of what i would call an acceptable timeframe for failure, even if the phone has a longer factory warranty.

yes you have the consumer guarantees act behind you but define acceptable usage, not time frame. time frame is only part of the equation here.

if you only used the stylus 2x per day then hell yes i would say try and get a replacement, but if your using it 20+ times a day i would say you have gotten good use out of it and its time to pony up for a new one yourself.

Some people barely use it. From the photo, the samsung logo isn't worn out or even appears scratched. But I do wonder how it failed in that way looking at how mine is constructed. Maybe the OP should google to see if it is a common type of fault. When I did a search, it seems that most peoples break at the join approx 2/3 up the pen which looks to be a weak spot..
