The onus is on the copyright holder to do the detective work I guess. I imagine that the biggest p2p sharers will get taken down first. And rightfully so - if that's the case. Interestingly, there seems to be lots of copyright infringement on popular internet websites e.g. youtube, etc, but it doesn't seem like this law is targetting viewing of such websites?

Yes received one when I was with Xnet and it was something I had half downloaded on bit torrent but then cancelled it so I had never actually received the entire file. I was pretty angry at the guilt upon accusation so I found another ISP.

And that had nothing to do with the ISP really, they were just forwarding whatever they received...

How is having part of a file which is essentially a useless piece of data breaching copyright?

ROFL... When the Parliament passed the changes to the copyright law a few years back they allowed format shiftting of audio CDs, but not video DVD. When asked, one of the MPs confessed he didn't know the difference. At the end they are bits, and you could say those companies are claiming copyright on parts of the work, not only its completed format.

They're specifically excempted.

  • ?(a)?offers the transmission, routing, and providing of connections for digital online communications, between or among points specified by a user, of material of the user's choosing; and





  • ?(ab)?allocates IP addresses to its account holders; and





  • ?(b)?charges its account holders for the services provided in paragraph (a) on a regular basis its services; and





  • ?(c)?is not primarily operated to cater for transient users







They are specifically exempted, yes, but they operate by running their business on residential Wi-Fi on a profit share model. Would this mean each Tomizone member was exempt from file sharing notices? Would be a fun road to go down...

What happens if you don't use Torrents to grab the movie. I never use to use torrents its far to popular those sites are screaming for attention, its probably full of movie police checking every file uploaded. So if they just check torrents then this copyright bill is a waste of time. I could name 20 other sites that use a different method. Hahaha all you torrent down loaders game over man! Suckers!

Seriously Ive gone back to waiting for the movie to come out on dvd. And you know what even though Im spending money where I know I could just download it, it feels great that Im contributing to the fat rich movie moguls and maybe helping out the video store owner make a living <-- I'm more proud of that.

Every weekend I hire out 5 movies for $1 each good to watch some oldies like this weekend I got
'One flew over the cuckoos nest'
Transformers 1 and 2,
fun with dick and Jane
and Pathfinder

and at least once per week I will hire out a new release. I'm getting the movie Devil next week.

But its weird you and I know they are available online to dl. Still its the right thing to do.

I bought 2 DVD packs yesterday - Black Books Seasons 1 - 3 and the 2 recent Batman movies. Usually I don't buy DVDs because I hate having physical media and just watch everything from a media PC but it is good to actually pay for something you really enjoy. 

I hate that to watch HD movies or TV shows I'd have to buy a bluray player when I can easily play HD files from my media PC. If I could easily pay to download (and not use my cap) movies and TV shows through digital distribution I would.

I'm mistaken, re-reading the bill, cafes/wifi hotspot operators are NOT IPAPs, they are "account holders". That means by the letter of the law, they'll basically have to shut down..

So speaking via latter of the law, there will be no more free/paid wifi hotspots in NZ.
