Probably not in breach of any acts, but possibly in breach of contract under the common law if the service is unusable or has been misrepresented by Telecom (which may be the case if they have contradictory statements over when throttling will occur which may be the case).

But if they say they are working on it then probably not a breach as they will have allowances for issues within the contract, but they do need to start being more vocal about what is going on and when it will be fixed. After the XT fiasco you'd think they would be more forthcoming with such information rather than just hoping people either don't notice or have come to expect such bad service from NZ ISPs, which is probably the case.

But that's just my 2c and I'm not a lawyer yet so that's just a layman's opinion.

Theres one slight difference between this and the XT problem, the XT problem was in the media.

Ok, it seems to be a little better today, downloads are running at about 20kb/s.

However, I've been emailed a large amount of photos for one of my third year engineering lab reports, and I can't download them, which is causing me no end of stress.

EDIT: Working now, and fanging along at a good 80kb/s.

The trick will be to see how it holds up this evening I guess. Plus the easter break starts tomorrow - oh the fun we'll have. You know, when we all go and do something else while waiting for web pages to load and such :(

I gather these issues with Bigtime arent just me then.

Cant play BC2 at all because I get timeouts and drop outs, even ANZ's Internet Banking is impossible.

Yeah same here.  No Gmail, no gaming, facebook is almost unusable.  I hope this is something that can/will be fixed.

+1 for epic fail currently.

10mb file from the us is running at a whopping 3.1kb/s and will be here in an hour.. I wonder if I can hit 1200 baud modem speeds later and relive my early days on the internet..

i believe gamin in AU is possible. but EVERYTHING that is hosted in the US is unreachable. connection drops out or even if I get a connection going pings are insane. SSH times out as well =\\
so today i canceled my wow subscription. 3rd week in a row unable to play. waste of money really ...

People have been having trouble on that plan too :(

I wonder if this problem is limited to Telecom? Or does thier problems effect other ISP's as well?

On a side note, what is this Global Gateway that seems to be the source of the problems?

And guess what? Still no update on the Telecom website to let Joe and Jane Bloggs know what the heck is happening with their internet connection. You know what will happen like most other faults? When they know a fix is near, they will put the fault up on the website, and within a couple of days they will have 'resolved' the problem in a swiftly manner. "Oh wow you're so fantastic Telecom for fixing the problems so fast" Joe and Jane Bloggs will say to themselves.
