To answer the OP, the law that gives the Government the right to impose the levy is the Telecommunications Act 2001, as amended by Acts such as the Telecommunications (Development Levy) Amendment Bill which increased funding for the Rural Broadband Initiative and established a Mobile Black Spots Fund. The retail telcos can then charge whatever they like, including labelling some of the price as a levy, provided that the laballing is not misleading.
