But anyway

 

The legislation deems a marketplace *for it's overseas vendors* as the supplier for purposes of GST.

 

Trade Me is included, for their overseas sellers since the 1st of December they are adding 15% GST to the price that the seller sets (overseas sellers don't do autions as I recall, but if you have a look in the TM announceements a few months back they outlined how they were complying anyway).  Seller sets price $100, trademe takes $115 from you, gives $100 (less fees) to seller, gives $15 to IRD.

 

For Aliexpress, all their vendors are overseas and so they add GST to all their sales.

That shouldn't give them an excuse to change the price without my agreement, though. It also doesn't change the order day. Being the subject of GST should be based on order day, not shipping day.

 

 

 

 

Hmm, I got hit with the same thing today - ordered on 28 Nov but card only charged today - I can now see a charge on my credit card for the amount + GST.  Oddly the order status on the amazon site still doesn't say shipped, and still lists the GST free amount.  Because it's not marked as shipped I'm tempted to cancel it (the order management page still gives that option because it's not shipped)  I have since found the main item on the order locally anyway and with the GST the cost is pretty similar... 

 

 

Just to let anyone know who was curious. Amazon refunded the charged GST, after I emailed Amazon's customer service with the screen shot of the November transaction I confirmed, side by side with the invoice they had amended prior to shipping and charging.  I got an email informing me of a refund for the additional charge (equal to the GST value). I did have to send about 4 emails and complain that they were not answering my query and instead just giving me a canned response copy and pasted from their wiki. However I am happy that they have finally refunded me and decided to abide by the amount I confirmed at the checkout. Hopefully they will be as accommodating when my USB memory stick arrives and I have to complain about it being a fake.

Who did you complain to?  Do you have an email address?

 

 

 

 

I went to Help -> Need More Help -> Contact Us -> Payment Issues -> Unknown charge

 

Then I typed in my initial query regarding the charge.

 

They then kept emailing me responses and I kept replying to the emails.

 

A different person replied each time, after the 4th one I complained that I didn't think they had actually read my query stated I was attaching a screenshot of my initial email / amount confirmation and their amended invoice to try to explain my problem. I also elaborated that a Sales tax has been introduced in NZ however it should only have been applied to any purchases made after December 1st and my purchase confirmed in November should not have retrospectively incurred this expense just because they decided to wait a few days before clipping my card and shipping.

 

After this no one actually replied I just got an email stating "we're writing to let you know we have processed your refund"

Raises some good questions though:

 

 - How does NZ IRD know how much turnover a company in say UK has to NZ customers?

 

 - what are they going to do about it if an overseas company quietly ignores the NZ law?

 

I can see with the obvious ones like Amazon, NZ could make a big fuss and stop buying AWS for govt.  But if Clove, or M&S etc just ignore NZ law, so what?

EG here's some text from a large sports goods retailer website:

What was the value?  Mine still says tax assessment.  Mine is about $920.



Around $500 so liable for GST to be collected but below the level of customs involvement.

Did you make sure that you emphasized this was a charge added after you confirmed the order and that it is not valid for your order date which is prior to the tax being applicable?

I tried to insinuate that it was quite fraudulent to take more funds from a credit card than the shopper agreed to however i did it by asking them to explain why they did this instead of outright accusing them.

I asked if they could explain why additional payment that i did not accept or agree to at checkout was added later with zero feedback to me.

I also asked if they could explain why this tax was being charged to me when it is not applicable to my order which was placed prior to December.

Not sure what approach you used but thats how i did it
