Couple days ago went to Spotlight Wellington and parked in their car park outside the shop, browsed various items. Curtaining etc as have done multiple times before. This morning received a ticket from Smart Compliance Management Auckland with photos and showing I was in the park for over 90 minutes and fined $65 for exceeding maximum time.

While there I bought a few items at 2 different times and have the dockets to prove it.

Called Spotlight and asked them since when was this policy of fining customers implemented and she said a couple of months ago. I said that as a VIP member they have our emails and why did they not inform everyone of this. Silent shrug.

I honestly don’t remember seeing any signage or warnings although there may be. Am I required to pay this fine? Any advice before I write to Spotlight or the ticketing company. Thanks.

Please do not pay this!

 

You do not owe them the $65 at all. They can't "fine" you. You don't owe them anything.

 

This is free parking meaning the total cost you owe them is $0. They can't claim for the cost of giving you the ticket as the person is employed regardless of if you were there or not.

 

Follow through this: https://www.moneyhub.co.nz/parking-tickets.html and make sure you've revoked authorized access here: https://transact.nzta.govt.nz/transactions/PersonalInfoAccess/entry

 

Parking companies do not have access to any persons details when they've revoked access. NZTA state this also (https://www.nzta.govt.nz/vehicles/how-the-motor-vehicle-register-affects-you/who-can-access-register-information/). If you look at https://gazette.govt.nz/notice/id/2021-au308 it specifically states "who have not instructed the Registrar of Motor Vehicles to withhold their details."

 

If the parking company argue that you overstayed, and state the breach notice is to be paid just give them $5 and tell them you consider the matter closed.

 

If after you've revoked authorized access you get a "breach notice" you can actually complain to the privacy commissioner.

I am surprised they haven't resolved it yet. A complaint to the manager of the store or parent company should have gotten some results. 



Nothing from an email to one of their managers n Auckland and nothing from Wellington Manager who assured me she would do something and nothing yet from the notice senders.

Yay! Just checked my email and had an email back from the first email I sent to Spotlight Auckland. Short and sweet that the Parking Breach has been waived.

Pity it didn’t arrive before I paid $10 for signature required letter. This has made me super observant of free parking and the fine print on signs they put up.

Karma requires a decent donation to some good cause in lieu.
