I would be interested in your opinion on this.

 

 

 

Do you think

 

 

 

 

 

"Goods must be sealed / unopened, with packaging in original condition. You will be offered an exchange or gift card based on the value paid at the time of purchase. We do not offer cash refunds."

 

 

 

adequately reflects this:

 

 

 

"Can I return an item?

 

For the first 60 days after your purchase you may return merchandise for a full money back refund, excluding any shipping charges." 

 

 

 

Both from same company website, different pages.

 

My feeling is that "a full money back refund" is not  "you will be offered an exchange or gift card".

 

 

 

I realise I can be quite literal with words but full  money back refund to me means exactly what it says. I am curious as to what would happen in an argument - which set of words is deemed to take priority?

 

 

 

(Note - I am not having a dispute with the company. I was thinking of buying from them and this caught my eye when I was doing due diligence.)

My $0.02.

 

I suspect they've used the copy and paste method of writing their T&C. Never good practice.

 

The first clause is problematic in that it is unspecific with regard to when an exchange or a gift card is provided and does not establish a clear policy. Offering "a full money back refund" in the first 60 days is explicit, and I would expect the company to honour that. I would however consider it reasonable for the item to be returned in a saleable condition unless it was explicitly offered as a trial.

 

EDIT: Since you are aware of the ambiguity before purchasing, then I would say the onus is on you to check the policy before buying.

How about sending them the links and asking  them, then you will have it on record what the actual policy is...

Agreed, if they offer a money back refund within 60 days then they need to honour that. Sure it's not in the CGA that they have to do this, but it would be treated as part of the sale like being offered free delivery or something.
