Hi folks, we are in a pickle at the moment please chime in

The main west coast line runs right through the middle of our property and has done since 2001/2002 no easement exists and as such we do not have the full use of our own private land we are currently on a 4g connection and fibre is not available

Moving the line is out of the question, so we are in the process of demanding they either purchase another 4 acre block OR they provide us with a fibre connection at THEIR cost however they need to do it

Its a shame we need to go to these extremes when this rollout was subsidised almost 100% by the government and chorus wont even shoulder the cost of the lead-ins instead opting to hire migrant workers on work visas

Someone correct if I am wrong but, if the cable was present prior to the telecommunications amendment bill of 2001 been signed its now protected even without an easement

I dont have the exact date that the fibre was laid but there should have been an easement it is private property our grandfather was bullied into thinking he had no choice that the fibre had to go through the property since he is old he would have known no better

The area is in the king country near te kuiti

The residential rollout customer facing was subsidised by the government, the backhaul which is what is through our property possibly was not

There is no dispute over who owns the cable, the issue is over the ongoing fact it is on the property and there is no compensation of any sort for the fact we cannot utilize our own land to the fullest it cannot be developed at all as it is through the heart of the property

The minimum we would accept is a fibre connection as compensation, i just was wondering if anyone else has epxperienced this

No nothing at all, he remembers the day the telecom contractors turned up with tractor and mullplow and said they were here to lay an important cable for the country so naturally he assumed that he had no choice when a bunch of people turn up with machinery

Instead of keeping it against the fenceline it went directly through the guts

Hi, as this is backhaul fibre there is no direct UFB in it, so to supply you with UFB from this either a new tail would need to be run just for you from the nearest splice point, which could be 1 or more km away, and even then its unlikely that a UFB accessible fibre is in the bundle to access, so the cost to do what you are after is probably way more than any reasonable compenstaion.

Further, I would doubt Chorus would want to start any precedence, that could get waaayyy out of control.

As above, back-haul and retail UFB, while related, are two totally different things. It's similar to national grid power pylons crossing a farm - you can't simply hook a house up to the pylons - there is a bunch of expensive equipment that needs to convert it down to a retail level and it simply isn't economic to do it for a small quantity of customers.

Businesses don't walk past potential customers - if it was as simple as splicing in to an exiting cable, you and your neighbours would have salesmen trying to sell you a fibre deal.

I am fully aware that backhaul is different, there is copper in the same trench as the fibre that was laid in 1988, there are 2 pits 600m north and about 300m south of our property, there could be a splitter etc housed in either pit

Regarding your comment Cyril about compensation... what would you define as a fair deal? as far as we are concerned we are providing options for chorus to do the right thing which is more than fair instead of take, take take because after all their preach is "Better Broadband" in a nutshell isnt it?

The bottom line is a very important cable is preventing us from utilizing the land period & they need to do the ethical thing here, most of the country has access to fibre

So you say you cannot do what you want on the land, which I can understand, but what exactly can you not do, I presume grazing stock is not a problem, and cropping is also possible?

What limitations are there.
