Me again. I finally decided I wanted to be able to use the home button on my first generation iPod Touch. I called iService in Howick, Auckland which is where I took my second generation iPod touch when it was having battery issues. I called them up and told them my problem and they said it would cost over $300 to repair the home button! How do they justify this price? I paid $445 for this thing brand new and its out of warranty by 1 year and a month or 2. Isn't this breaking the CGA? For not having spare parts or something? I heard they replace iPods rather than fix them but surely they just send my one back, and get a new one for me and fix the part on my old one and bill me. Why does apple have to be so different -___-

wait what? iService don't sell ipods so how are they breaking the CGA here? They are a repair company. they can charge you a $1million if they want to, providing they tell you the costs upfront.

CGA applies to Apple and the company you bought the ipod off from like dse, noel leeming.

also how can it possibly be out of warranty by 1 year and 2 months specially when it's 1st gen ipod touch which was released in mid 2007?

I saw LV martins selling the 1G ipod touch early last year when I got my 2nd gen one, so a retailer with old stock still may have been selling them. If it is only 2 months out, I would definately go back to the retailer.

Apple told me all repairs have to go through an authorized repair center and iService is the closest one to me. So since they would get the parts and stuff from apple, they're effectively apple themselves because they run on Appples command. And the guy on the phone at apple said according to my serial number its just over 1 year and 2 months or over 400 days and is out of warrenty.

Have you made raised your case with Apple Customer Relations? They could conceivably grant Customer Satisfaction (CS) coverage to replace your unit. 00800 7666 7666 (international toll-free). Express how unsatisfactory the product is... mention the CGA etc.

Also being an Apple Authorized Service Provider just means you are a local service agent authorized by Apple to perform repairs and service on their behalf. It's not really at all the same as being Apple. It's not iService's problem, they can only do what Apple permit.

If you want to proceed with a claim under the CGA, then you should first go to your Reseller, (with your quote for repair and your original proof of purchase) and if they wont help, then go to the Manufacturer.

Ok I'll try that tomorrow. It sucks because I always try to take care of my stuff. I have mates who drop their iPod's on the ground on many occasions and their iPod's are perfectly fine and they treat them like crap. Wonder if e-mailing Steve Job's would work? lol. People e-mail him all the time.

Heh you can try. I've had one customer have a reply, it did not help his case tho.
Also did you see Jobs's recent reply to a developer complaining about the how bad the new iTunes 10 logo is... "We disagree."

Well thats all I'm really expecting. Took him on a major guilt trip saying its my primary source of email and I "might" jailbreak. **wink**

Seeing Apple's response to every problem lately, I doubt I'll get anything. "all smart phones have this problem" yeh right. Only way my Nokia loses signal is if I take sim out... Please... lol

I had my iPod touch 1st gen replaced with a similar issue - home button collapsed and the only way I could use it was to push it with a stick really hard. I also take care of my stuff too... I didn't bash it or anything - just suddenly went "pop" and wouldn't spring back up again. What's your issue? The majority of people seem to have a non-responsive button rather than physical damage.

I didn't have to go through too much hassle as it was in the last 3 months of the 1 year warranty period - I still have my replacement 1st gen iPod touch with me with no issues for the last 2 1/2 years! Smile 


I hope this doesn't sound too nosy but I was kind of interested into how/why you got a first generation iPod touch a year ago?

Well over the coarse of a week or 2, the home button slowly stopped responding to the odd push, but would work if I pushed it a few times. Then it got worse and I'd have to push it super hard to work then it just stopped. If I push any harder I think I might crack something else because its right above the dock connector. So now it doesnt work and I jailbroke it and installed iHome for SB settings so I can get home without rebooting.

And I didn't get an First gen a year ago. The warrenty expired just over a year ago. they said its 400 or so days over warranty. I got a second generation one on boxing day last year which is still in warranty.

I would say that you've got a slight chance with the CGA though now that's been over 2 years since the purchase date and 3 generations, I would think that it's not that big a chance. But never say never! Smile

Though it would be a real waste of an iPod just because of one physical button.

I know. Its still a good iPod. Better than the second/third generation ones because it doesnt roll as it has a flat back which is awesome. Although it's not as fast, it doesnt miss many features my new one has. I never use the built in speaker or volume rockr's so those arn't big issues. Battery isnt as good as its fairly old but its a good alarm clock. :D.

I'd say there is a 100% chance getting a repair under the CGA (assuming this is not liquid or 'shock' damage).

A reasonable lifespan for an mp3 player would be 5-7 years (from the consumer.nz website - get a screen print if you can). 

Your iPod is less than 3 years old if I interpret correctly. 

Ask the retailer if repairs are covered under the CGA.  If they say no, ask for this in writing, head down to the disputes tribunal , lodge a claim. 

It will not be a good look for the retailer to be intentionally breaking New Zealand law. Doubt it will get this far anyway, retailers always cave when you mention you want it repaired according to their obligations under the CGA.

I don't really think these life spans are realistic. A premium desktop computer has a reasonable life span of 5 years, according to some previous CGA cases. I don't think you could realistically argue that a portable media player should be expected to last 7 years.
Of course you are entitled to lodge a CGA claim, but to actually act on it you have to go to court. At some point quite quickly it becomes cheaper to bite the bullet and get a newer, better unit.

Hmm, replying to myself for the second time today.
I've realized I misread your original post. I thought it was 1 to 2 months outside warranty. In this case, Apple might come to the party. I didn't undertand it is 13 to 14 months outside warranty. I think it's pretty unlikely in this case that Apple will be very forthcoming, unfortunately.

Perhaps time to upgrade, the new retina display is awesome! Plus all the other good stuff too...

I have a second generation touch but its a shame to see this one break. Its the principal more than anything. What happens if I don't win at the disputes tribunal? Do I have to pay anything?
