Wondering - all new devices come with iWorks for free.. thats fine. But what happens if say I purchase a second hand iPhone 5S.. am I able to still claim the free iWorks download?

No it's linked to the iTunes account that registered the device initially.

Although what happens if that initial owner didn't register for the free software nor download it prior to selling th phone? Or is that ability to download it tied to that initial owner of the device still. Eg. So if they have an older device, they could download the free software for that other device in the future. Or can the new owner donload it. I pressuem there is something in the phone that has that trigger that allows the free downloads.

If the original owner never registered any accounts on the device then the first account to do so would be able to install the apps.
