Really? It's noticably faster with Telecom? Youtube videos etc load properly and everything?

Yes, youtube is loading perfectly and I am not getting those < 1Mb download speed to LA/San Francisco during peak times that I used to get with orcon every single night anymore.. and again I am happy with the result!

Mine has been really really slow, just browsing sites is slow... orcon.... how long does it take to fix an issue and not have it happen again?

I'm in Mangere Bridge. National data speed is usually fine, it's just international http traffic that is terrible; youtube in particular. Sometimes on Ondemand the program will stream satisfactorily but the ads will keep freezing up.

From my point of view there have been problems since May 2009 - thats like 15 months. I didn't notice any improvements with that recent international bandwidth upgrade a couple of months back, if anything things got worse.

We are in the hellish position of being in a new subdivision where there are not enough ports in the cabinet (thanks Chorus) so we're stuck with Orcon - how unbelievably awful :(

Residential broadband is a shared network best effort service with no guarantee of minimum performance or reliability, it's just the nature of the beast.

Changing to an ISP providing better performance right now is probably your best option.

I'm not certain this is actually true. It would not surprise me that legally there are strict limits to the amount of legal protection such a device can provide, particularly where what is being delivered to customers in no way resembles what they were offered. In my opinion Orcon is committing gross misrepresentation of their Internet service as "Broadband Internet", when in actual fact vast numbers of its customers are receiving what some might regard as equivalent to lackluster dial-up.

I would happily sign up to a class action if suitable lawyers could be found prepared to represent claimants on a pro bono basis. Personally I think New Zealand needs such a case in order to deter future would-be shysters in the ISP industry. Looking at this thread I'd say there'd be quite a number of fellow claimants.

Orcon and its parent have an incredible cheek upgrading their offices and running television advertising campaigns aimed at growing their customer base when they are patently unable to deliver reasonable service to their existing customers. The inevitable result will be even more degradation of service quality as the bandwidth gets shared out with the additional customers. I would not be surprised if this is actually criminal, if a judge could be convinced that laws and regulations pertaining to party lines were applicable to Internet service providers for example. I'm sure there are a raft of telecommunications laws that could be used to prosecute them.

Are there any attorney's or judges with experience with telecommunications law or class actions in New Zealand following this thread? Or does someone know such a person who might be prepared to look at what's going on and offer some comment? I would be very interested in what they have to say.

Thanks for coming back and posting your results. It's very interesting, there have been 2 or 3 individuals at least now from the start to the current point in this thread who have changed from Orcon to Telecom with impressive results.
I'm currently sticking with Orcon... for now.
Not because I'm wanting to stay and keep whining about the issues without doing anything;
But because of a couple of reasons:
Other members of my household point blank refuse to return to Telecom after some past customer services nightmares.
Also, they and I agree that broadband would probably still be really slow and expensive if not for some of the good work done in recent years by companies such as Orcon - if Telecom had their way.
I just hope that with enough customer pressure, management at Orcon will get a fix in place so that they can at least be on par with Telecom, if not better than them, and SOON! 
If customers don't say anything it will be assumed we're all happy with the <mediocre speed.

Honestly it would be a waste of your time, the most effective thing you can do is vote with your wallet and change ISP if you are not happy.
