I am now living back in the last century courtesy of Orcon. I had arranged to move to Spark as a protest for Orcon not following through on Global Mode to test its legality. For reasons I don't understand Orcon cut me off last Monday despite them saying I had to give 30 days notice which is not for another week. After waiting 4 days to get connected to Spark I have been told the exchange is full and Spark can give me no date when I might get connected.

I contacted Orcon to see if they can reconnect me and was told that I would have to sign up for 12 months and they will not tell me if they can connect me unless I sign up first. It was their stuff up in the first place.

Orcon sent out emails to all their customers back in July or August I think it was to say that global mode was being discontinued. They said that because of that if you wanted to disconnect you could do so with no early termination fee during the month of August or September (cant remember the exact months). So theres no need to test the legality because they officially said you could disconnect with no pentalties.

In regards to the 30 days notice this is mainly for billing. When asking to be disconnected you need to specify a date for the disconnection (this can be anything from a few days to a few months in advance). You could ring Orcon up to confirm what was keyed in for the disconnection date but since there was a week difference there probably is no point. As all it will prove is who is right and who is wrong.

In regards to the stuff up at best you are owed 7 days internet, not a full reconnection. Going forward whats more important? Principals or Internet. If Internet just resign up for 12 months with Orcon. With luck Orcon have their own equipment in the exchange and a free port. If principals then either stay on the waiting list with Spark or try gaming the other providers. Do note though that alot of the ISPs are owned by the same parent company so do research to ensure your money isnt ending up in the same place.

Ill identify some issues here,
You have left orcon and the line is now owned by spark so they cant just reconnect you.
Chorus by the sounds of it got no spare lines at the exchange. 
If that's the case your old line has been vacated to the next person in the line.
And you will be in a port waiter queue.
Dealt with these issues every day where customer will change ISP's and never realize its a full exchange/cabinet and then be stuck.
As it goes "If its working no need to fix it"

Hi there,

My apologies for any inconvenience caused by the early disconnection.

Realistically it doesn't sound as though there is much we can do on this I'm afraid - through cancelling your Orcon services you have likely lost your port and it has been assigned to someone else who was in a waiting list. Even if you were happy to sign up with us for another 12 months it is more than likely you will end up at the bottom of the waiting queue for a port.

Send me a PM with your account details and I'll make sure you're not charged for the services where you haven't been able to use them. Let me know if you'd like to get another order placed with us, otherwise all the best with your new ISP and I hope we see you back on board at some point!

Yet again... NEVER contact the service you are leaving until you are up and running with the new ISP. This should be up in bold letters on every ISP website. The problems always start with someone contacting their current provider and advising they might/will be leaving them before they have secured and are operational with the new provider. Trying to save an extra few weeks or a month fee just isn't worth the trouble.




Lazy is such an ugly word, I prefer to call it selective participation

The point is that had the OP tried to sign up with Spark before disconnecting with Orcon, they would theoretically been told by Spark there were no free ports at this time and therefore could have remained with Orcon with a working connection in the interim.

If the OP had contacted Spark the change would have simply been a transition of the intact connection, so would have not caused a port waiter situation.

If the OP is now a port waiter Orcon aren't going to be able to reconnect them any quicker than any other ISP.

You could churn your connection every month for a decade on an exchange with a 2 decade long port queue if you wanted,  churn/transfer of service is "I want my port serviced by X new ISP".

(Okay a little extreme example, but best way to explain it)

A straight disconnect order (as requested of Orcon by the OP it seems) will free up the port, and whoever is #1 in the port waiter queue finally gets internet.

Spark have been rather poor in this as well. They have not once contacted me, I have contacted them and on two occasions with different support people - when they told me I would be transferred on 17 October and I finish with Orcon on 9 October that there would be no need to contact Orcon as they never disconnect anyone until the new connection  is made. I am not sure whey I got disconnected last Monday however.

Chorus contacted me yesterday saying they were in process of making the transfer and would contact me when it was complete, they never said there was an issue and never called me back

Seems a bit steep as I was disconnected before my term with Orcon was up. It expires on 9 Oct.

I have no luck getting an update fron Spark when they are likely to be able to connect me, but after phoning Spark again I got a different story. I was not a broadband waiter, rather the file only said there were no connections available

If Spark do end up connecting me I might end up with a $199 disconnection fee plus I assume a months notice.

The deal with Spark was a $300 joining credit so I will have to see what will end up cheaper in the long run
