Hello all

I came across this interesting add on stuff.co.nz for a 2degrees ideos phone see the picture http://yfrog.com/gz0kd7p the 3rd phone is meant to say $149 but it says $49. I went into the store to see if i could get it for $49 and they didnt


If you go onto the stuff website a christmas cracker comes up when you pull it the picutre in the link comes up

Opps. But rather than false advertising, I suspect you're really looking at a case of human error.

All the examples it shows you before that final graphic (ie right after you pull on the cracker) it clearly shows "Buy $50 top up and get $50 off new phone, $60 top up, $60 off" and so on

Worth trying, but even using the CGA you aren't likely to get that deal.

Yes, they do there, but the graphics on the Stuff website shows the IDEOS beside the $49 price.

CGA has nothing to do with it.  You'd be looking at the FTA, but I think this would fall under a geniune mistake.  It's pretty easy to follow that if it was $300 originally and you top-up $150 and get $150 off the phone that it should be $150, not $50.  The OP figured this one out himself, so I doubt anyone was misled.

Bazzer beat me to it...I don't think this has anything to do with the CGA, it's more the Fair Trading Act. This from the Consumer Affairs website:

What are my rights if a shop advertises something at the wrong price?
Although the shop has probably breached the Fair Trading Act, the only loss or damage you have suffered is a wasted trip to the shop. You can ask them to compensate you for this, but you cannot force the shop to sell you the goods at the advertised price.

So as you have not encountered any "loss" other than time posting on GZ I don't think you have a leg to stand on. Mistakes happen...move on





Lazy is such an ugly word, I prefer to call it selective participation

yeah, if it is a genune mistake (which is what it looks like) then you have no right to that price.

of course, they do have to amend their advertising within a reaosnable amount of time when they become aware of the mistake or else it does start to get into the realm of false advertising.

banner type ads on websites can be changed pretty quickly, so if the incorrect ad is still up in the next couple of days then you could, in theory, have a case.

Oops, thanks for spotting this folks. We’re making the change right at the moment. It should read “If you top up $150 you get and IDEOS for $149” – which we think is a REALLY good deal!

I brought a 2degrees phone form Dick Smith the other day using this promotion.  It was an utter stuff up.  The phone was $129.  I paid for it and they gave me a $50 voucher.  I said hold on, i want to top up $150 and get this phone for free.  It all got too complicated for them as they said i could only do it in $50 amount lots and that i was getting the vouchers for free not the phone and i was now entitled to only $100 worth of vouchers.  Being xmas and it was a mad day i just took the $100 vouchers (lost out on the extra $29 voucher) and said that it's wrong, they blamed 2 degrees saying that it was there stuff up, really i think it was their stuff it as they didn't know how it worked.
I'm happy to pm the store name to a 2 degrees GZ member if they wanted to follow it up.

^MD let's have a little chat about your call center staff.... bloody brilliant! What am I going to whinge about if your staff are as helpful as the guy who I just got to help me sort out my number port?!

I'll have to start writing shorter posts on GZ?!

* the guy speaks English
* knows his customer facing web site well
* was able to answer all my questions without refereeing to someone else for help

Was also able to help me make sense of this voucher offer thing that the retail store didn't really explain at all... I just got handed the voucher, which I confess was a nice bonus.

I would like to have been able to add my data purchase using the web, as I'm not big on texting codes, but have to confess 'buy 50mb' to 233 really isn't that much effort!
