SepticSceptic: Time to consider on-dash cams ? They are cheap enough, but would they be suited for defending your claim ?

I wouldn't see why it wouldn't be - Their camera will be nothing special either. Just an off-the-shelf model which shoots video and has a time stamp on the video, I'd imagine.

Aaroona: to answer all the questions re video/pictures;

I have just called AT Transport who have advised me they have video on file.

I have requested that send this out to me, which will arrive within 5 working days.

If I were to make judgement purely based on the photos - you are 'guilty'. The series of pictures assume that you must have been travelling in the bus lane throughout.

The video should tell whether you are right or wrong.

thats what I've asked for now- I've asked them to send the raw video footage. They said they'll put the request through and it should be here within 5 business days

I know at one point they were looking for unfair or unreasonable parking tickets. I'm sure they would be interested if the video shows you did not travel the entire length of the bus lane.

Also, as someone said, look carefully at exactly what they are charging you with. You should be able to look up the legislation, regulations and by laws to see exactly what they have to prove to convict you.

Ah good old Auckland City Council aka Auckland Transport. Looks like they haven't improved with the name change.

Five years ago I got a parking ticket in the mail from them. It was somewhat of a surprise has I hadn't been in the fair city for quite sometime at least not in the city centre where the alleged offence occurred.

The information on the ticket "invited" me to contact them via their website which I duly did or I should say tried to do. I got no reply the first or second time I tried, even though they promised to reply within 24 hours. I took a screen of of my second attempt as proof. I finally resorted to snail mail to inform them they were mistaken explaining at the time of the alleged offence my car was parked at work in Hamilton and asked them to cancel the ticket.

They replied with words to the effect "We don't care, you are guilty, pay up." I replied that to my knowledge in New Zealand a person was innocent until proven guilty and unless they could provide evidence of my car being parked where and when they alleged it was I had no intention of paying them any money.

They wrote back telling me the ticket had been cancelled but inferred I was still a naughty boy and was fortunate that on this occasion they had decided to cancel the ticket. The arrogance of the letter astounded me. There was no hint of them being sorry for getting it wrong.

i watched an AT worker in an AT vehicle drive for more than 50m in a T2 lane during the lanes hours yesterday

should have taken a video, would have been a good way to get out of a ticket :)

Me 2 cents is that they use the intersection you pulled out of as a distance marker (for their pre determined distance) and have the camera where the bus lane ends.

Without reading the legislation for bus lanes (and other similar court cases...) this information is to be taken with a grain of salt! But I think you would have to prove that manoeuvre a (your initial move into the correct lane) and manoeuvre b (your second move in to the bus lane to turn left) were separate and that manoeuvre b did not occur within 50 meters of the bus lane ending. Be interesting to see what the video shows. Hey, at least it proves your were indicating ;-P

To be honest, I feel this is an intersection they would have a lot of experience in dealing with and I'm sure there is some interpretation of the rules somewhere that explains it (and the council hold back on). Why they can't explain it to you over the phone or in a letter is a shame but then I guess fines would increase to cover the cost of a "personal touch"!

So the footage finally arrived.

After reviewing the footage, to the letter of the law I am at fault - I did go into the other (correct lane) lane (i.e. more than 50%), but my passenger wheel didn't leave the bus lane, therefore I was in breach of the 50 meter rule.

I'll eat my words and watch myself in those situations :)

On a related subject, has anyone appealed against a parking penalty at Albany Park & Ride. Arrived there at 0806 last week and due to lack of spaces, parked on a berm/verge area covered by low-lying scrub. Received a $40 ticket for that. No signs visible anywhere in the car park saying I shouldn't park there, and not causing an obstruction. Pay up or appeal??

Been a lot of complaints about that in some Facebook groups.... was never an issue until the start of this year IIRC, and one day everyone found they'd been ticketed and when queried, "its not part of the car park".

Yes, its annoying etc, but fair enough as well, its not labelled as a parking area - do you want strangers parking on your front lawn ? :)
