I just realised something (from someone else's post on facebook) : https://shop.jbhifi.co.nz/termsconditions/Information are not the T&C that are displayed when you actually order something..

I cannot find any links on their website which links to https://shop.jbhifi.co.nz/termsconditions/Information at all so how am I to know about this version of the T&C if there is no way to find it (without actually being told to go there retrospectively )

Section 7 actually says: (Go and order something and see the T&C displayed)

7.4 says they can cancel any order without any reason given (Nothing about wrong pricing)

Saying all that.. They are quoting a T&C that I didn't agree to. The 2 T&C have quite different information in them and 1 impossible to find)

Example...
-------------
7. ORDERS
7.1 You may place an Order by following the instructions on the Website. Your Order will be submitted by completing payment details and pressing the "Complete Order " button. Orders will be deemed to have been received by JB Hi-Fi at the time JB Hi-Fi sends an Order confirmation to your nominated e-mail address.
7.2 Each Order (once accepted) represents a separate Agreement incorporating the terms of that Order.
7.3 JB Hi-Fi reserves the right to not accept Orders that request commercial quantities of Goods. If JB Hi-Fi is unable to supply your total Order this Agreement will apply to the supply of all or part of the Order.
7.4 JB Hi-Fi will use its best endeavours to supply Orders placed through the Website, however JB Hi-Fi reserves the right to cancel any Order without notice for any reason.
7.5 In event of a cancelled Order, any payments processed by JB Hi-Fi will be promptly refunded
7.6 Customers who wish to cancel a Order must notify JB Hi-Fi at onlinestore@jbhifi.co.nz by 9am on the next business day following the date of Order, quoting the Order reference number.
7.7 You acknowledge that the Internet can be an unstable and, sometimes, insecure marketplace. At times the Website may not be available, or Orders may not be processed or may not be accepted for reasons beyond our control. In these circumstances JB Hi-Fi accepts no responsibility.

I'm assuming temporary authorities applies to my case then and it will take a few days longer for the charge to be reserved and for my credit balance to return to normal

I believe their bank need to 'fax' your bank to get it removed sooner. Apparently otherwise it can take up to 10 days. I believe fair go did a story on this only a couple of weeks ago with petrol stations who were putting holds on peoples credit cards.

It depends on who their payment provider is and if they have issued a reverse transaction or not. If JB haven't reversed the transaction then it will depend on how long the provider will hold an uncaptured payment for. Most providers I deal with default to ~28 days but who know's what this could be.

There is strength in numbers. If anyone wants to make an issue out of this, for example through the Commerce Commission for false advertising, I would be happy to join in. I agree that genuine mistakes can happen and should not be penalised but I also agree that the company has not handled this well. What is to stop any company from making crazy advertising promises and then claiming after the fact that it was an error?  There has to be some kind of accountability to prevent abuse. Maybe 20 or 30 of us should send a joint letter to the company (in the first instance). What do the rest of you think about this?

The second chorus of the song "Mutha'uckas" comes to mind here.
