It's quite a reasonable analogy.

If you want your [journey/download] to go as fast as possible, then [LandTransport/TelstraClear] should build [roading networks/data networks] able to handle the peak load of [traffic/traffic] regardless of the number of [cars/people downloading stuff] trying to use it at the same time.

Clearly, no-one expects roading networks to be built to handle absolute peak demand, so why expect data networks to be built that way? Note, if you're an experienced network designer familiar with cost contributors at a Telco level, feel free to offer specifics about how you could build their network heaps better for half the price)

If 'LandTransport' said that people wouldn't have to pay fuel charges for driving on the roads from 1800 on a Friday evening to midnight on Sunday and the roads were full of people just driving up and down for no real reason apart from the fact that they could do it for free, and you had a journey you wanted to do but couldn't get there because the roads were full of people just driving up and down and those roads weren't capable of accepting this unusual use, I think you would have a right to complain!

Fuel is closer to electricity - it's the lack of roads having tolls (generally) which breaks the analogy slightly. In any case, tough. Just consider it's a Sunday in parts of the country, with people taking pointless trips to do nothing (Like I just did for 90 minutes to enjoy the sun) or holiday periods, when people clog up the roads with their pointless holidays.

You need to remember that for all the people complaining about the performance, I'm _DAMN SURE_ there's a lot more people hungrily snarfing as much TV and movie content as they can and feeling quite satisfied, fat and happy about the offer. Are you saying their use of the resource is less important than your use of the resource?

detsoob was a bit foolish to list the actual terms and conditions you signed up to when you ordered the service, because clearly almost everyone expects _FAR_ better performance than they actually pay for.

You however are very foolish to suggest they haven't met "published service" when in fact I _strongly_ suspect IF there are ANY published service specifications, they will have met them.

I am completely open to being proved wrong, so if in your contract, or the terms and conditions you have with TCL, you actually do have specified service performance specifications, GO RIGHT AHEAD and provide a link to them here.

We're all waiting.

You are right , it was foolish of me to expect a Telco to act with integrity and honesty. The IT /Telecommunications sectors are some of worst for meeting service promises and quality assurance and I am a 25 year IT veteran.

If they are doing it legally then they are entitled if they are in breach of law and owner rights then no they are not entitled.

The 'tough' was in relation to the lack of perfection of the analogy.

Let's recap.

For 2 days out of 30, some customers haven't been able to get the same performance as they are used to, while many haven't noticed a difference. However all customers are allowed to download as much as they like over the weekend.

They didn't take away the service you paid for. Many many people will have got huge value from the weekend and I fully acknowledge it's had performance impacts on some.

Your insult towards TC helpdesk staff isn't appreciated. The insult to me flows off my back like a thousand tiny IP packets.

If you see and actually look carefully he actually works for Telecom , You sir are a fool and obviously don't read what he is saying ,  I think its pretty much spot on.

And  honestly hope your not one of those people that think by yelling at someone in the faults or sales or customer care team is the right way to fix things?

Speeds aint been the best as they normally have , They gave everyone prior notice so either make the most of it or stop bleeting.

I think you'll find that't not how the law works, plus the ISPs have _no idea_ whether any particular traffic is infringing on copyright or not.

To be brutally honest yes, I do think people should be able to use a service they pay for (I pay for 60GB per month that I do not use fully and wasn't going to change my use this weekend) before others get a chance of using something they don't pay for!
