Does anyone have any experience with or recommendations of divorce lawyers in Auckland?

Massive story short: my ex wife doesn't want to sell the house we own and that's not a tenable situation for me!

Offer her the option to buy your half of the house of today's valuation.

To the OP, sorry for your situation, but we went through a situation somewhat similar where we inherited a portion of a property that one party didn't want to sell but she wasn't in a position to buy us out of, so we had to get a lawyer involved. 1 letter and it was sorted. Was painful and caused a lot of misery.

Yeah not an ideal situation at all, I'm just not left with any options other than engaging a lawyer even though I want to keep things as amicable as possible.

$500 + GST for an hour of Mr Sutton's time!

Looking on the bright side, a week from now, the house will be worth $2000 more than it is now...

Well yeah it's worth about $1.1m now with an $830K mortgage so we stand to do ok out of it, unfortunately logic and common sense aren't prevailing at the moment.

$830K mortgage.

Good luck - hope it goes well an the long run. But....

Holy cow - That sort of mortgage scares me. Glad I don't live in Auckland. Here I am debating if to increase my mortgage up to $180K to do up a kitchen. Something is seriously wrong with house prices.

I believe in cases like this the only fair method is to sell and split the cash.

Valuations are unreliable as the market is crazy  -we had a valuation done which said the house was worth 540k and it sold for 630k a month later.    Nice to have an extra 90k sitting in the bank account for doing nothing.

Doesn't say it's an hour. Probably more like 20 mins?

Don't worry, she is making you rich by delaying!

$1.1m is about what the divorce lawyer makes in a years salary :)

No kids involved that are with her? Not sure if that matters or not though

I guess your ex has three choices:

  1. she buys you out
  2. you (both) sell and split the proceeds
  3. you (singular) turn up with a chainsaw and take your half.

Ask her which she prefers.

Seriously though, I'm sorry to hear you find yourself in that situation. My suggestion is that you sit down and talk calmly and rationally and explain that you want to resolve this amicably and #1 and #2 are the only options. If she doesn't agree with either let her know all future conversations will be through your lawyer.

Which could mean she may have to get a lawyer, and pay that as well
