The pictures below show what the guys have done to connect our house to the road.

Instead of putting the cables under the drive way they put a pipe next to the fence. As you can see in the second picture, when it comes into my property, the pipe is between the retaining wall and my neighbor's fence. Technically the pipe is in my neighbor's property.

Is this how they normally do it? I thought they needed to dig the driveway and bury the cables under the driveway. It just seems to me that they have not done it properly? Will not putting cables under the ground affecting my internet speed? Will it more likely to break say in 10 to 20 years?

Also because it's not underground, who would be responsible for fixing it if the conduit is damaged?

Another update.

The contractor came back said they received complaint and will put the cable underground.  I wasn't home (my wife was) so they will come back on Monday to give me a few options how I would like it done. So far so good. :)
