The Justice Department does not just hand documents back. The DOJ has already set up a "filter team" to review the seized materials before they are viewed by investigators to determine whether any of them are protected by attorney-client privilege, according to the Wall Street Journal.

Trump's claim of executive privilege is far more legally dubious, legal experts said.

"Anything that falls under 'executive privilege' doesn't belong to him. It's still government property and belongs in the archives," tweeted Teri Kanefield, a former appellate defense attorney. "So he admits to being in possession of stolen material. Someone needs to tell him he has the right to remain silent."

This is pretty sad, how Trump (in part - other part conspiracy theories) ruined a marriage, but I imagine this most definitely isn't an isolated case:

That's a pity 😞 her politics are quite different to mine, but I have to commend her for standing up for the right thing (the Constitution, not the wishes of one man). I'm sure she knew this might happen though.

 

All these Trumpers must be quite smugly pleased with themselves right now, but the day will come when the orange buffoon is no longer around I get the feeling they won't know what to do with themselves.

Trump is not the last of his kind. Ron De Santis (R. Gov FL) would be a candidate to take up Trump's mantle, as well as Greg Abbott (R. Gov TX) - both of whom are as conservative as they come, as self-serving as they come, and as malicious as they come.

He's using the chapter on subverting democracy from the book "How Democracies Die". First step is to remove the checks and balances, of which the US had two. One is already gone, the Electoral College. Alongside its better-known role of ensuring that states with large populations don't drown out states with small ones, it also ensured that only sound candidates got in because they chose them. After the disaster of the 1968 Democratic Convention this was changed to allow candidates to be selected by popular vote in the primaries. The Democrats fixed this in the 1980s which is why Hillary got in no matter what the popular vote actually said. The Republicans didn't, which is why Trump got in no matter what the party actually wanted.

 

 

The second check is the judiciary. Trump has already packed the Supreme Court with conservatives, but for a full autocracy he needs his loyalists in there, not just general conservatives. To do this, he needs to follow the playbook from pretty much every south American country that turned itself into a dictatorship or banana republic. A lot of those adopted the US Constitution, in some cases verbatim, as their own national constitutions, when they gained independence. What autocratic leaders did to get around the courts is either to impeach sitting judges and replace them with loyalists, or stack the court with loyalists and push out the actual judges.

 

 

Once the checks and balances are gone, you perform a law-and-order crackdown on anyone you don't like, control the media, and follow the usual playbook for an autocracy.

 

 

I'm not aware of anything in the US that can stop this. No-one's ever tried it before, but that's not because it's not possible, just because it's not a done thing. Now that any demagogue outsider who doesn't care about what's proper and what isn't can get in, there's nothing there to stop them continuing on.
