Ah no. If a business makes a profit in New Zealand that profit is taxed in New Zealand.

Check your facts... Plenty of companies shipping to NZ that dont have a presence in NZ, let alone an IRD number. ANd lets not forget they not a company in Australia either.

So you are suggesting that Sanitarium are going to drop ship Weetbix direct to the consumer from Australia?

Umm. How about no.

Here’s another fun fact. You don’t need an IRD number to be liable for tax.

So who audits these international businesses?

You speaking nonsense if you believe companies that have no New Zealand presence need to pay tax in New Zealand (besides gst) . The ird number means a New Zealand presence, that’s why I brought it up.

Are you seriously implying that Sanitarium is going to commit tax fraud?

I’ve really seen no indication that you have much of an idea of how tax works, either domestically or internationally.

Please explain how you think they could commit tax fraud if they are not liable to pay tax even in aus.

Maybe the word you looking for is tax avoidance (minimization of tax liability by lawful methods) they already doing this and it’s not illegal, hence this thread.

Come back with some legal quotes to your claims because currently you are just blowing hot air.

What exactly did you want them to do?

This is what has been previously suggested, and looks like Labour are going to do it if they get back in. (Which is unlikely based on the polls).

A quick search of the Companies Register in NZ....

Sanitarium has a registered presence in NZ, the NZBN is 9429035446705. Company Number is 1503254

NZ IRD number required for registration

Here is a crazy notion, lets give peace a chance.

They also still manufacture some products here.

Their head office and manufacturing facility is still on Pah Rd in Royal Oak. A lot of their products are imported but some are still made here.

Sure.

In the hypothetical scenario proposed they would close their New Zealand entity and trade from their Australian entity. That doesn’t really change anything as any New Zealand operations would still be subject to New Zealand company tax as it would still be operating as a trading business in NZ.

It’s also entirely impractical as they would still need to have sales, warehousing etc in NZ as well as accounts receivable. The supply chain and banking issues alone preclude this approach.

You clearly know very little about 3PL logistics,

It's disappointing that the Mod's have allowed what was purely a commercial dispute, degrade into a church bashing thread...

The Warehouse can be incredibly hard to work with, it's pur form for them to use the 'social media kangaroo court' to force their way/terms onto a much smaller company like Sanitarium.(or abusing social media to get their way with any commercial arrangement) - I hope it comes back and bites The Warehouse hard.

@handle9

There does not need to be any nz presence. Why you talking about warehousing etc? They can just ship their marmite or wheetbix directly to your door from overseas.

The links you supply above are not accurate either for a non profit organisation.

You have missed the point totally.

Its latest fiscal returns show an annual revenue exceeding $A300 million ($NZ320million) and net profit exceeding $A10million. Not bad returns for a tax exempt "charity"

As per earlier posts in the thread, 100% of that net profit has to go to charity. It is not allowed to be used to benefit any members, trustees, or associates of the charity.
