The key words here are remove, replace, relocate and disconnect. Installing a smart switch is adding to the circuit.

Wonder if that's got any specific definition's in the code, Shellys and whatnot could be considered a fixed appliance

Remove and replace any of the following kinds of fittings, where the work does not involve work on any switchboard:

I'd clarify the "Remove and replace". Are you going to remove an existing switch and replace it with a Shelly?
