Well I just went in to check the lie of the land. The first thing they said was because it was 13 months old, it was out of warranty. The receipt says 12 months but the HTC website says 24 months. They seemed a accept that 24 months was correct. I was prepared to argue the CGA because it is a known hardware fault that renders the smartphone camera not fit for purpose and I would expect the hardware to last 2-3 years in a flagship phone.
I am going to return it to stock firmware before repair so they don't try to weasel out of it.

Im not an HTC user but I hear you can unroot it and then relock the bootloader?

BTW, CGA has your back with rooting

You are saying it doesn't matter if phone is rooted? I have always assumed that to be the case for hardware faults. I was just trying to avoid the possible arguments that would mean my phone was gone for longer by returning it with stock software.

Section 7(4 Meaning of Acceptible Quality) of the CGA says: Goods will not fail to comply with the guarantee of acceptable quality if—

(a)the goods have been used in a manner, or to an extent which is inconsistent with the manner or extent of use that a reasonable consumer would expect to obtain from the goods; and

(b)the goods would have complied with the guarantee of acceptable quality if they had not been used in that manner or to that extent.

I asked Consumer about this, They replied
Hi Blake, If you have rooted your phone (such a delightful term) and there is a non-software fault (i.e. screen fails or the headphone jack stops working) then you most certainly get it fixed under the CGA. Though you’ll have to do a lot of yelling. Anything even slightly software related will not be covered. And I have a feeling that outside of accidents, a good 90% (an estimation) of phone issues are software related. Hadyn Green So looks like it should be covered :)

Just fyi, I was dev unlocked and I just flashed back to a stock rom/recovery and sent my phone in. I had no problems with getting a replacement under warranty.

I have successfully returned to stock (but still unlocked) and will look at the best time to be without my phone for a fortnight.
How old was your phone and who was the retailer?

Mine was around 9 or 10 months old. No retailer as it was through Vodafone business arm (work account). Also work let me borrow an iPhone 4S for the week or so it took to replace it. It was pretty awful using an iPhone but at least I had a phone (and now a better idea of why I don't use an iOS device)

I would recommend maybe getting a Motorola Moto G from Amazon to use for the meantime and then sell it afterwards.

Nice thought, but I will just be bringing my One X out of retirement and putting my Telecom sim in it.
My One is over a year old but HTC's warranty seems to be 2 years according to their website. I would prefer that rather than have to argue the CGA with them, although the evidence is pretty compelling that it's a manufacturing/design defect. Kind of kicking myself for not taking it in prior to both 12 months and unlocking it.

If you have a warranty paper saying 2 years you could easily argue it. don't even mention the unlocking - likely they will never figure it out.

I see after android L revealed at the Google I/O HTC have announced both the M7 and M8 will get it within 90 days of its release. So that would be about December this year, probably the GPE though, so the sense based Ones first quarter of next year.

Holy cow, that's pretty quick. And it seems like they've been pretty good recently at almost perfectly hitting those aggressive promises. Gives me a lot of faith in HTC.

Just a shame that the network verification part is so much longer.

Switch to GPE instead, or grab an OTA copy from whichever market gets it first, maybe? Personally I've wanted to try GPE for a while on my One, might have to just do it...

I actually quite like some of HTCs addons, so sticking with stock is probably best for me. Android is so good these days, that I'm not absolutely hanging out for an update just to get something functional, like I was in the old days. I did love me some Cyanogen ;P

Plus, I don't want to re-live Dingbatt's stress about rolling back if I have to claim a repair under warranty lol.

I agree about the HTC sense 6 software additions. Feel that it is probably one of the best skins for android (much better than Touchwiz or Sony's skin). I really wish that HTC make some of the apps available on the Play store so I can actually download it and use it on my Nexus tablet (like the Mail or the Calendar app).
