No. You can't contract out of the consumer guarantees act. It is the minimum legal requirement.

So they are _giving_ customers a $400 phone to tide them over until the N7 is replaced? That seems particularly generous. I'm impressed with how proactively this is being handled.

 

I turn the fast-charge option off anyway as I didn't trust it to begin with, I only tend to charge the device at night, so if it takes 4 hours instead of 2, I really don't care.

 

The J5 looks to be a competent enough phone, might make a good upgrade for the wife after the job is done :)

Just got the message below in a text from Spark

FROM SPARK: If you own a Note 7, Samsung advise it is recalled for safety reasons. Please stop using it & return it to point of purchase for advice on options


Given the unattractive options I was offered when I went to point of purchase, I'm going to guess that this is CYA. Makes me wish I was dealing directly with Samsung. Maybe as this goes on, pressure will make them offer better options, but it's disappointing that their initial response has been what it has. That's true even though I would probably not use the "free phone" offers if I had the option.

I should have moved to Vodafone.

So Spark told me via facebook they will give me a J5 mobile to keep (like vodafone have from the start). I rang the nearest open Spark store and they say no way. Typical just after Spark text and say "stop using it".

I've also been told different things from the same company - Noel leeming. One said yes we will lend you a phone. The other said no Samsung will lend you a phone if you go through the website. Ugh!

Have just returned from Vodafone Albany where I dropped off my N7 and was handed a Galaxy J5, sealed in its box. I have recommissioned my HTC One M7, which the N7 was to replace, and put the VF SIM back into that. Will go on with the HTC until the replacement N7 is available.

 

So I now have a factory-new J5 to keep which is surplus to requirements.

 

The VF Albany guy handled it very well. He admitted he was feeling his way a little because it was the first N7 return they had done - but all good.
