A friend of mine used to know someone that did something to do with "marketing" for them - apparently it was pretty close to being a pyramid scheme of sorts. Personally I'd stay clear of them.

Australian Communications Network Pty Ltd gives undertakings to the court

The Australian Communications Network Pty Ltd has given undertakings to the Federal Court, Adelaide following Australian Competition and Consumer Commission action.


The ACCC instituted proceedings on Monday, 15 November 2004 against Australian Communications Network Pty Ltd, a seller of telecommunications services, for alleged breaches of the pyramid selling scheme provisions of the Trade Practices Act 1974
 
The focus of the ACCC's proceedings is the CAN's marketing system. Independent Representatives pay ACN $548 (including GST) and sell those services to consumers. Independent Representatives also have the right to recruit other Independent Representatives. Those Independent Representatives can receive commissions from their personal customers as well as commissions from customers of Independent Representatives they have recruited. In addition, Customer Acquisition Bonuses are paid on the number of qualified Independent Representatives. ACN has co-operated with the ACCC's investigation and provided substantial information about the operation of the scheme. However, ACN disputes the ACCC's allegation that the ACN scheme is in breach of section 65AAC of the Act.


The ACCC is seeking declarations, injunctions, corrective notices, compliance programs for the companies and the individuals, findings of fact and costs. The ACCC also sought an interim injunction that would prevent ACN from accepting payments from participants, which the ACCC alleges are "participation payments" within the meaning of the pyramid selling provisions of the Act, until the hearing and determination of the matter.

OT: not all network marketing products/services are "pyramid scheme". There are a few MLM (rarely) that are trading publicly on NASDAQ, and also, in NZ and Australia, if they're given the approval from Direct Marketing Association certification, then they've been checked through by the Government to make sure it is not a pyramid scheme.

Also, do you know what is "pyramid scheme" before crying it out so loud? Just to educate you, pyramid scheme does not have a product to sell, and all it tries to sell is idea or concept with money up front to the lead person. Where as network marketing (or MLM) does actually have products to sell, like Avon, Amway, Tupperware etc.

AND also, all businesses and corporation cannot escape the organisation structure that looks like pyramid. Ponder on this for a while... we all are in a sort of pyramid in any organisation.

In any business, you have an CEO or Director at the top, then you have top management personnels, then you have team leaders, then senior staff, then at the very bottom, you have the information workers, office assistants, cleaner etc. So tell me, how is that not appear to be a pyramid?

OR in school... you have Principal, then the teachers, then the students... seems like a pyramid structure again.



So my advice to you all, pyramid scheme is bad, but network market that has been certified to operate in the country by the government are not. And all orgranisations, businesses or corporations, cannot escape the structure of a pyramid.

If in doubt, call up MED (Ministry of Economic Development) and check with them with the company or network market that you are concerning about, and let them dig up the dirt for you.

True, it certainly is not but they're monitored by Government for their operation, and the associations need to be at an acceptable level of operation which deem to be a good business practice, hence not a pyramid scheme operation.

Bottom line is, network marketing is not pyramid scheme.

MED: Pyramid Selling Scheme
More importantly:
Multi-level marketing v pyramid selling
Multi-level marketing usually involves commercially viable products (eg, clothing, jewellery, cosmetics, health products, cookware) which present genuine business and income-earning opportunities through repeat sales to clients.

Pyramid selling schemes often involve "gimmick" products (eg, certificates) or grossly overpriced products or services that have little or no resale value (eg, personal development programmes, magazine subscriptions).

Mum signed up with them. At the time [still am] we were on Telecom freedom with two phones and they took all our calls, put some hidden charges [didn't see the reciept] but i did see [and hear] 3000!?!?! on the computer screen and mum yelling that out.

And they charged for local calls too. So me spending two hours talking to my friend about what Laptop she should get didn't help things.

I have no idea how she got rid of them. All i know is that i rather "stick with the devil i know" than "stick with a devil i don't know"

I have since been in contact with the NZ commerce commission:

They are aware of ACN as they have had many inquiries regarding 'ACN as a pyramid scheme'.  NZCC hasn't investigated into this because no one has asked for further legal advise, such as taking them to court.  If they were to go to court, each person selling ACN (or connecting them to ACN without selling) are then liable!!

NZCC are also aware of the court case in Australia and have been watching ACN in NZ very closely.

This was enough for me and with the help of each of you on Geekzone to decide that I won't be involved with them at all. I am concerned with my friend who is involved and swears by them...
