Hi guys.

I ordered myself a new bed yesterday from Bigsave which cost $499 (excluding Delivery), probably around midday if not just after. I got told this morning that Bigsave had 30% off storewide today, am I within my rights to ring Bigsave and ask for the difference (Its less than 24 hours) to be paid back into my account? I haven't even got the bed yet, supposedly it is coming later today.

I know Noel Leeming is good like this, if you buy something and then come back within 24 hours because they have made it cheaper they will give you the difference back.

Thanks

There is nothing in consumer law that gives you such a right (and could never be anything like this either)

The most obvious thing would be to approach Big Save and speak nicely to them.

Nope, you don't have that right. You can ask nicely though.

+1.
Did you pay full retail with the initial purchase? Or was it 'discounted' already? It may not be the full 30% less than what you paid (todays price). You have no 'rights' in the case. All I could suggest odd as Steve has said above. Approach Big Save, say how disappointed you are, and see what their customer relations is like. Check also if they have a returns policy which may allow you to 'return' the bed before re-purchasing it. It may be that they could give you a store credit, but in the end it is entirely at their discretion.

The bed itself isn't discounted because its "One of Bigsaves everyday low prices". However the radio advert says 30% off everything... interesting.

wow, why on earth would you think you had the right to the cheaper price?

do you think if the price had gone up 24 hours later, Bigsave would have the right to charge you extra?
of course not, so why do you think you somehow get the right to get a cheaper price?

I have got the price difference credited back numerous times. In the original post I stated Noel Leeming does it for me no problem, even up to 7 days. Have had it done at other retailers I am sure also. Thought it was just common procedure really until now.

I agree with the others. You are within your "right" to ask them, but they are within their "right" to say no. Definitely do not bring up the CGA!

If they're not keen to give you the 30% back as a refund, see if they'll be willing to drop a few sweeteners in with your order instead as well.  Ultimately, they don't have to do it - but they are likely to want to come to the party in some fashion to try and turn a negative experience into a positive one.

However, you have no right to it - you would definitely want to drop the sense of entitlement you've displayed in your OP when you talk to them (whether you intended it or not, that's how it came across).

What about if you paid by credit card? I believe you have a 7 day 'cool off' period, or is that in a different scenario? If so, you could (assuming they didn't respond to your polite request) ask to cancel the sale and then repurchase...

The only time you would have a come back would be if you explicitly asked if the product was going to come onto special in the next few weeks and you were told 'No'. Usually sales staff will just say they don't know.

Good heavens, this thread is still going?  The answer is right there in the first response from Steve.  Ask really nicely, tell them you're more likely to return for repeat business if they will give you refund for the difference, but if they don't just move on with your life; you obviously thought the original deal was OK otherwise I assume you wouldn't have bought it.

While some may choose to do that, the simple logistics of it would mean it could never be enforced by law.

Imagine if supermarkets had people come back every Monday morning wanting refunds on their groceries they'd purchased the day before because they were now on special!

The CGA appears to be the master filter of peoples "rights".

CGA actually falls under a bigger rule called Caveat Emptor, but everything else that is Caveat Emptor, but is not covered by the CGA is actually under a category called 'Sux4u'

Some credit card companies will refund the difference if you find it cheaper within 7 days. My BNZ gold does this. Nothing to do with vendor though.

My views (except when I am looking out their windows) are not those of my employer.
