oceanlyner: So it turns out Spark were cutting the speed in half each night 6pm-12am. Moved to the 500GB plan and now have no issues, constant speed all day.
Just have to sort this master filter out to see if I can get anything faster than the 7.5mbps I am getting.

oceanlyner: They told me they were doing it when I was trying to figure out what was going on.
Changed to the 500GB plan rebooted my modem and the speed was back to full.

oceanlyner: Yes that is what I was told. I spoke to 3 different people and was very clear that my physical speed was dropping, they all mentioned traffic management. Seems like a standard response for them.
It's working better now though that's all I'm worried about.

I think that's the key here - perhaps the level 1 tech support is getting confused. They cannot make your xDSL resync at a lower rate every night.
