On your privacy policy page, many sentences are capitalised, and many are not.

e.g.

(a) Those who provide to us or our group companies products or services that support the services that we provide, such as our dealers and suppliers;

(b) Credit reference agencies (unless we have agreed otherwise) who may share your
information with other organisations and who may keep a record of the searches
we make against your name;

(c) if someone else pays your bill, such as your employer, that person;

(d) Text charges will apply even if the messages are not received by the intended recipient for whatever reason.

Sounds to me like you are potentially (and possibly unwittingly) contracting a customer out of the Consumer Guarantees Act, which is not allowed under NZ law.

If a customer sends a text, and you do not have the ability to pass it on, because of say, an outage, breakdown or whatever, then you will not have given the service paid for, and under the CGA will be required to rectify that (by way of a refund/credit or put the service right and deliver the message).

  • Nobody is paying me :(
  • Yes I really want a Centro. A free one even.
  • I have mowed the lawns, walked the kid, emptied the pool and waterblasted it, dismantled/cleaned/remantled the BBQ, bought all new socks and discarded old ones with holes + much more :-)

My notes in bold throughout...

You want me to ensure that the Website is not used for illegal activity? Huh? What? Thats YOUR job!!

other security measures;
(d) Not to post or use any software or device which may facilitate a continued

Pointless statement - the Act does not permit any contracting out of itself.
